Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

1) This inspection was initiated in response to a complaint. The complaint alleged that: (1)
The firm was using an unpermitted “frac” tank for storage of septage in an area
approximately 300 ft west of the Myers Septic Tank Company office, where according to
the complaint leaks and spills of septage were occurring around the tank’s location (2)
Pumper vehicles parked on the property used by Myers were leaking septage on to the
ground surface. (3) Spilled septage from the unpermitted tank and leaking trucks was
flowing into a stream on the southern boundary of the Myers property.
2) Two trucks appearing to be in service were present at the time of the site visit and were
inspected. A conventional 3500 gal pump truck and a flat bed style truck with a slide in
pump unit. The flatbed truck was not listed on the permit. According to Myers the flat bed
was in the process of being made ready to be added to the permit and was not used for
managing septage at the time of the inspection. The 3500 gal truck displayed required
lettering indicating firm name, phone number, septage management firm permit number
and town name. The lettering was permanently attached to each side of, was plainly
visible and met height requirements. The word “Company” in the firm name was
abbreviated (Co.) where spelled out on DWM records.
3) The septage holding tanks on both trucks were constructed of metal and appeared to be
structurally sound.
4) The tanks on both trucks were affixed to the truck with permanent fixtures.
5) The septage drain valves on both trucks appeared to be in working order.
6) All port covers and caps where in place and appeared to be in proper working order.
7) No leaks or spills of septage were observed around either truck.
8) Pump logs were not checked

A “frac tank was observed on the property approximately 300 feet west of Myers office. The
tank was empty and no sign of septage spilled or leaking was observed in the area surrounding
the tank. According to Myers’ staff the tank was being repaired with the intent of eventually
adding it to their existing SDTF permit.
The area adjacent to the stream on the southern border of the Myers’ property in the vicinity
of the frac tank, was inspected for signs of any impacts or runoff from the site to the stream.
No signs of septage or any other liquid material was observed entering the stream from the
area surrounding the frac tank or the area upslope being used for storage of portable toilets
and other items.
