The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell inspected the Merritt Brothers NLCIDLF after calling office and going by office on 5/20/2022 and
not speaking with anyone. Mr. Powell went back by office, after inspection, and met with Riley Merritt and explained corrective actions discovered during the inspection. Mr. Riley also gave Mr. Powell the contact information for Donna Burton, whom he spoke with after the inspection to explain the correction actions and discuss a timeline. 2. Site is secured by fence and gate, and roads were of all weather construction. However, road access only to the front and one side of the LF. Access should be available around the landfill for firefighting and inspecting and measuring of buffers. 15A NCAC 13B .0564 (7) - The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment.
3. Site needed compacting, additional soil cover over all exposed waste and proper 3:1 sloping. Proper compaction of waste may assist in subsidence and erosion of the site. Slopes should be maintained at no less than
3:1 during filling, disposal and grading activities. 15A NCAC 13B .0566 (2) - Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time. (3) - All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65.

4. The facility needs Edge of Waste (EOW) markers showing the four corners of waste, so that proper buffer and size measurements can be taken. After speaking with Ms. Donna, after inspection, she indicated they were installed just overgrown and needing to be maintained. Please address these EOW markers so they are visible and marking the 2-acre notification correctly. 5. There is some concrete waste that is behind the NLCID. Either this is waste meant for the NLCID, and it needs to be disposed inside the 2-acre notification waste boundaries or it is a recyclable material that needs addressing, otherwise its an illegal dump. Please address.

6. There were a couple large trees growing between the roadway and the NLCIDLF needing removal. This can hinder firefighting vehicles, compacting and covering waste inside the landfill.

7. It is the responsibility of the owner/operator of a NLCID to ensure the site is managed according to the LCID rules. Rules for LCIDs changed in 2021, copies will be provided with this inspection, along with a letter from Edward Mussler explaining some of the rule changes. Corrective measures are necessary as a result of this inspection and should be complete within 60 days’ receipt of this inspection report. A follow up will be conducted around that time or shortly afterwards to confirm. If completed beforehand, communicate with Mr. Powell and he can schedule a follow-up as soon as possible to confirm corrective
