ADDITIONAL COMMENTS
On May 17, 2022, Chuck Kirchner and Robert Pike met with Tyler Lunsford and Lee Cloer with Orange County Solid Waste to conduct a comprehensive inspection of the Orange County Regional MSW Landfill - Household Hazardous Waste Facility on Eubanks Road in Chapel Hill, Orange County.
1. The facility is a permanent household hazardous waste (HHW) collection facility located adjacent to the Inactive/closed South Landfill Unit owned by Orange County. 2. The County operates two other active, permitted, and permanent HHW collection centers. One is located on Walnut Grove Church Road in Cedar Grove, NC and holds Permit No. 68-05. The second facility is located on Eubanks Road in Chapel Hill, NC and holds Permit No. 68-06.
3. A new permit was issued by the Solid Waste Section Permitting Branch on December 30, 2019. This new permit combined the 68-01 closed MSW permit with the 68-04 C&D permit. The 68-03 HHW permit was
incorporated into the 68-01 permit as part of the “Post-Closure Land Use Operations Plan”. 4. This HHW facility (68-01) is no longer an active HHW drop off facility. 5. This facility ceased accepting HHW in late August 2018. 6. Orange County Solid Waste has designated this facility as an HHW overflow area in case 68-05 HHW and/or 68-06 HHW are unable to store materials and as a storage area for paints and household hazardous wastes for
short periods of time. 7. During this inspection the HHW was not being used to store any HHW materials to include fluorescent bulbs which were formerly stored on site in the main HHW building and in one of the adjacent storage sheds. 8. Latex paint is being dried in a plastic lined dump trailer in one of the adjacent sheds to the main HHW building. The latex paint is being mixed with shredded paper as part of the drying process. 9. During this inspection the paint drying procedure was discussed with Orange County Solid Waste. 10. On the approved Ops Plan dated 12/4/19 Section B-4 states: “Should the paint be dried, paint will be mixed within the paint cans containing the paint, metal vats, plastic lined containers, such as a plastic lined carboard box, or similar containers conducive to drying paints. Mixing will be done by adding an appropriate amount of kitty litter, clean soil, sawdust, shredded paper or similar material to adequately dry the paint. The dried
consistency of the paint will be determined by Orange County Solid Waste employees to verify the paint has thickened adequately and no liquid remains. Drying will be performed by manual labor. Staff performing drying procedures will wear appropriate safety personal protective equipment (PPE).
Dried paint will be disposed of as MSW in an approved, permitted facility. Dried paint will be transported to the City of Durham Transfer Station for transfer to Sampson County Landfill. As the dried paints will be disposed offsite, the County will be responsible for ensuring solidified paints cross the scales and appropriate tax is paid. Taxes will be paid in cost savings by not paying a HHW vendor to dispose of
the paint.”
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

11. The dried paint shall not be disposed of in the C&D landfill. 12. The main chemical storage building is equipped with an indoor fire suppression system. T&S Fire & Security, Inc. last inspected this system in 2017. 13. Prior to reactivating the unit for processing and storing permitted wastes described in this part, the permittee
shall notify the Regional Environmental Senior Specialist for pre-operating inspection to ensure that the unit is ready for the approved operation. The inspection may include the function of ventilation, secondary containment system, illumination, fire prevention, building security & communication, etc. 14. The HHW Facility Annual Report was submitted on July 27, 2021. From July 1, 2020 through June 30, 2021 the facility did not accept and manage waste.
15. A second shed contains recyclable plastic bags. 16. Ensure any liquids stored on site have adequate double containment as needed. 17. The Chapel Hill Fire Department and/or the New Hope Volunteer Fire Department can be contacted to
address an emergency at the facility. 18. Only Orange County Solid Waste staff are on site during operation.
19. The site is secured by a locked gate. 20. The facility has proper signage. 21. Access roads are of all-weather construction.
