Solid Waste Management Facility Permit No. 10003T-TRANSFER-1995 (FID 1322280) dated September 6, 2019,
includes:
Permit Approval to Operate 10003T-TRANSFER-1995 Yancey -Mitchell Transfer Station; and
Permit for Closure 10001-MSWLF-1987 Yancey -Mitchell Sanitary Landfill and 10002-CDLF-1997 Yancey -Mitchell
C&D Landfill.
PURPOSE OF SITE VISIT:
Partial Facility Inspection.
STATUS OF PAST NOTED VIOLATIONS:
A. CORRECTIVE MEASURES ONGOING. 15A NCAC 13B .0203(d) During this inspection, the slope failure
area on the northern slope of the closed municipal solid waste (MSW) landfill was observed (photos #1 & #2).
Labeled flagging had been placed around the slope failure area since the previous facility inspection. The size of
the eroded area appeared to remain unchanged since the previous inspection. (Note: emerging vegetation
obscured some views of the eroded area.) Continue to coordinate with Section Permitting staff regarding the
slope repair, as referenced in the Update on Site Progress letter (FID 1646840) dated March 2, 2022, and the
Slope Failure Project Milestone Proposal letter (FID 1646841) dated March 3, 2022.

B. RESOLVED 15A NCAC 13B .0505(7)(c) Since the previous inspection, the facility has met the conditions for
responding to and evaluating the April 2019 leachate release, per the approved soil assessment plan and Section
requirements, as stated in the Section's Approval of Leachate Release Soil Assessment letter (FID 1627157) to
the facility dated December 16, 2021. Please be advised that any future/additional leachate outbreaks at the
facility will require immediate repair as necessary to protect human health and the environment.
(Note: the 15A NCAC 13B .0500 Rules were readopted effective January 1, 2021. Post -Closure Care Requirements for
closed MSWLF Units exempted from other MSWLF Rules are currently in Rule 15A NCAC 13B .0510.)
C. CORRECTIVE MEASURES ONGOING. 15A NCAC 02C .0108(o) In a letter to the Section dated
December 6, 2021 (FID 1626448) the facility's consultant stated, "Anchor QEA will have new well tags made
for wells MW-2, MW-3, and MW-AR. The tags will be installed during an Anchor QEA quarterly site
inspection." As this was a partial inspection to observe the landfill cap, monitoring wells for the closed MSW
landfill will be observed during the next facility inspection. Please ensure identification plates/well tags are
properly installed at the facility for wells MW-2, MW-3, and MW-AR during the next quarterly site inspection.
(Note: the 15A NCAC 02C .0100 Rules were readopted effective January 1, 2019. Standards of Constructions: Wells

Other Than Water Supply .0108(o) is currently in Rule 15A NCAC 02C .0108(p)).
OBSERVED VIOLATIONS:
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. On -site to observe the slope failure area on the northern side of the closed MSW landfill, as well as the vegetated
(grassed) cap on the closed MSW landfill. Facility records were reviewed prior to conducting the inspection.
2. Post -inspection, additional facility records and information were provided by the facility Office Manager and Yancey
County Manager on May 4, 2022.
3. During this inspection, a small area of pooled water (approximately 4' x 8') was observed on the southern, central
portion of the landfill cap (photos #3 & #4). As discussed post -inspection, although recent, heavy rainfall occurred at the
facility prior to this inspection, continue to observe and maintain the closed MSW landfill cap as necessary.

4. Per facility personnel, mowing of the vegetative cover on the MSW landfill cap occurred during the second week of
April 2022. During this inspection, the vegetation appeared to be well established on the grassed portion of the landfill cap
(example photos #5, #6, & #7). Also, it appeared during the recent mowing event that vegetation and briars were cleared
around all landfill gas extraction wells and other appurtenances/features on the cap. After mowing events occur at the
facility, continue to ensure the landfill cap is inspected for impounded water (refer to comment #3),

subsidence/differential settling, cracking, signs of erosion or damage, and that any necessary repairs are made in a timely
manner.
