Upper Piedmont Regional Landfill 9650 Oxford Road Rougemont, NC 27572 GPS COORDINATES: Lat.: 36.32567' Date of Last Inspection: October 20, 2020 Long.:-78.83028' FACILITY CONTACT NAME AND PHONE NUMBER: Name: Scott Harless Phone: (304) 964-5031 Email address: wharless@republicservices.com FACILITY CONTACT ADDRESS: Same as above PARTICIPANTS: Amanda Thompson, NCDEQ, Solid Waste Section Drew Hammonds, NCDEQ, Solid Waste Section Tim Davis, NCDEQ, Solid Waste Section Scott Harless, Republic Services STATUS OF PERMIT: A modification to the Permit to Construct MSWLF Phase 3 and Operate MSWLF Phase 1, 2, and 3 (Cells 5A and 6A) was issued September 1, 2020, which allowed for an increase in maximum tonnage from the previously permitted 240,900tons/ year to now 780, 000 tons/ year. In accordance with North Carolina General Statute 130A- 294(a2), permits for sanitary landfills and transfer stations shall be issued for the life -of -site of the facility unless revoked. Life -of -site ends when the facility reaches its final permitted elevations or by June 24, 2057. PURPOSE OF SITE VISIT: Compliance Inspection and Introduction of Tim Davis STATUS OF PAST OBSERVED VIOLATIONS: A. 15A NCAC 13B .1626 (2)(b), "Except as provided in Sub -Item (c) of this Item, the owners or operators of all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors." PARTIALLY RESOLVED: During the inspection, exposed waste was observed along the access road to the working face, along the side slopes, and around newly installed methane collection piping. Additional cover soil will need to be applied over areas of exposed waste prior to the seeding and stabilization of the areas. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS Upper Piedmont Regional Landfill, 7304-MSWLF- 1997, is permitted to operate Phase 1 (Cells 1A, 2A, 3A, and 4A), Phase 2 (Cells 113, 213, 313, and 413) and Phase 3 (Cells 5A and 6A) of the municipal solid waste landfill. The facility is approved to accept an average maximum annual disposal rate is 780, 000 tons per year. 1. The facility is fenced and is secured by a locking gate when it is not open for operation. 2. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. 3. The facility accepts waste Monday through Friday from 7:00 am until 4:30 pm and 7:00 am until 12:00pm on Saturday. 4. The permit, and operations plan, and records were reviewed and up to date during this inspection. 5. The facility has certified personnel on site during the hours the site is open to the public. The certified personnel on site are: Jeffery Hawley, Certified Landfill Operations Specialist, LF-2007020, exp. 3/16/2022 William Harless, Certified manager of Landfill Management, exp. 7/5/2024 Michael Jackson, Certified Landfill Operations Specialist, LF-2013030, exp. 5/9/2025 Mr. Hawley has been scheduled to attend the May 2022 class to update his certification. 6. No woody vegetation was observed on the side slopes. The vegetated portions of the landfill should be mown as needed to allow for proper inspection of the landfill. 7. Erosion rills were identified on the non -vegetated portions of the side slopes. The erosion rills need to be repaired, properly graded, and vegetated. Ensure that any exposed waste in the erosion rills is properly covered during the repairs. 8. Permanent edge of waste (EOW) markers were observed around the landfill. A portion of the southern side slope had recently been repaired and an EOW marker in the area may have been missing. Ensure that the EOW markers are visible from one to the next. 9. The perimeter roadways around the landfill are being properly maintained. During this inspection, the water truck was in use and applying water to the access roads to suppress dust. 10. Numerous erosion rills were identified on the side slopes of the C&D Area 2. The erosion rills need to be repaired and graded. 11. Several areas of dark staining were observed along the eastern side slope. Monitor the areas for possible leachate seeps and repair as needed to prevent leachate from leaving the EOW. 12. The erosion and sedimentation measures near Phase 5 have become inundated with sediment that has washed down the northern side slope. The sediment basin located near the southeastern corner of the landfill also had excess sediment within the basin. The erosion and sedimentation measures should be cleaned out to ensure that they function properly. Mr. Harless stated that the sediment basin near the southeastern corner of the landfill was scheduled to be cleaned out. 13. The working face is small and compact. 14. Windblown waste was actively being picked up during this inspection. Portable fencing was also positioned near the working face to help catch the windblown waste. Ensure that the windblown waste is picked up by the end of the day. 15. Erosion control measures consisting of vegetative cover, materials, structures, or other devices shall be utilized to prevent silt from leaving the site and to prevent on -site erosion, and shall comply with 15A NCAC 04, which is incorporated by reference including subsequent amendments and editions.", areas that will not be receiving waste for 12 months or more will need to have intermediate cover. Ensure that the areas also have vegetative cover to prevent on -site erosion. 16. Digital photographs were taken during this inspection.
