C&D Landfill.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. On -site April 22, 2022, to observe the closed C&D landfill cap and slopes, site access roads, facility environmental
monitoring wells, stormwater management/conveyance features, erosion control maintenance, and facility mowing
maintenance efforts. Facility records were reviewed prior to conducting the inspection.
2. Post -inspection, additional facility records and information were provided by the facility Office Manager and the
Yancey County Manager on May 4, 2022.
3. The Closed Yancey -Mitchell C&D landfill ceased receiving waste June 30, 2008. Closure in accordance with NC
Solid Waste Management Rule 15A NCAC 13B .0505 was certified on May 29, 2009.
4. Access to the site is located off Landfill Drive and is controlled by a lockable gate.
5. Facility perimeter fencing, barriers, and signage appeared to be maintained.
6. C&D Landfill Quarterly Inspection Logs for the I't Quarter of 2022 and all 2021 Quarterly Inspection Logs for the
facility were available for review. Previous Quarterly Inspection Logs for the facility were also available for review. As
discussed post -inspection, continue to conduct quarterly landfill inspections and maintain any areas of concern as
necessary.
7. The upper access road for the facility appeared to be maintained. As referenced in Quarterly Inspection Logs for the
C&D landfill, the lower access road leading to groundwater monitoring well MW-H should be maintained. Continue to
maintain access roads at the site as necessary.
8. Edge -of -Waste (EOW) markers were observed around the C&D landfill. Continue to maintain EOW markers at the
facility as necessary.
9. Semi-annual groundwater and surface water monitoring reports for the facility, dated February 2022 (for Fall 2021
sampling event) and May 2021 (for Spring 2021 sampling event), were available for review. Previous semi-annual
monitoring reports for the facility were also available for review. As required, continue to monitor all groundwater and
surface water sampling locations at the facility and submit reports to the Section.
10. The groundwater and surface water monitoring network for the C&D landfill is comprised of 3 groundwater
monitoring wells (MW-H, MW-I, and MW-J) and 2 surface water monitoring locations (SW-1 and SW-2). During this
inspection, access appeared to be maintained for all groundwater and surface water monitoring locations at the site.
Continue to maintain access for all water quality monitoring locations at the site. During this inspection, the information
on the identification plates for groundwater monitoring wells MW-H and MW-I appeared to be fading and should be
maintained as necessary. Additionally, as observed on -site, the identification plate for groundwater monitoring well
MW-J has been maintained since the previous inspection (photo #1). The Section appreciates the county's efforts to
maintain well identification plates for the C&D landfill.

1. Identification plate observed on monitoring well MW-J
during this inspection.
11.2021 Quarterly Landfill Gas (LFG) monitoring reports for the facility were available for review. No LFG
exceedances were observed. Previous quarterly LFG monitoring reports for the facility were also available for review.
As required, continue to monitor all LFG sampling locations quarterly and submit reports to the Section as necessary.
12. LFG monitoring for the C&D landfill is conducted at 6 screening locations (CD-1 through CD-6) around the
perimeter of the landfill. LFG monitoring data is obtained by sampling ambient air utilizing a calibrated, handheld
methane monitor at each approximate screening location. The facility also monitors for LFG in the following seven
structures located on the property: Tipping Station building, Scale House, and Boiler/Heater building, and in the
Mayland Earth to Sky Park (formerly EnergyXchange) area in the Visitor's Center, Clay studio, Glass studio, and
Gallery. During this inspection, access appeared to be maintained for all LFG locations at the site. Continue to maintain
access for LFG monitoring locations at the site.
13. No apparent leachate breakouts or seeps were observed during this inspection.
14. Per facility personnel, mowing of the vegetative cover on the C&D landfill occurred during the second week of April
2022 (example photo #2). As discussed post -inspection, a low area on the upper, western slope of the C&D landfill cap
should be monitored for settling and/or subsidence and maintained as necessary (photo #3). Also, above this area on the
western slope of the C&D landfill cap there appeared to be evidence of a burrowing animal (photos #4 & #5). Please
maintain any burrowed areas on the cap as necessary. Additionally, eroded areas/tracks were observed on the northeastern
slope of the C&D landfill cap (photo #6). This area should be maintained and re -vegetated as necessary. (Note: as
discussed post -inspection, if it is determined the tracks were caused by unauthorized ATV use, please ensure no
trespassing occurs at the site.) Continue to re -seed and or establish vegetation on any other bare/sparse areas of the closed
C&D landfill cap as needed (example photo #7), and also continue efforts to remove any woody vegetation on the C&D
landfill slopes within the EOW as needed (photo #8). After mowing events occur at the facility, continue to ensure the
landfill cap is inspected for impounded water, subsidence/differential settling, cracking, signs of erosion or damage, and
that any necessary repairs are made in a timely manner.

15. Continue to maintain all erosion control measures at the facility as necessary including rip -rap channels, sediment
detention basins, permanent diversions, and inlet/outlet stabilization structures. Small trees/shrubs should be cut and/or
removed as necessary from rip -rap channels at the site. Additionally, continue to manage and maintain surface runoff at
the facility to ensure positive sheet flow to conveyance measures at the site.
