Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All photos were taken by Lee Hill on April 26, 2022. 2. The facility is open Monday through Saturday, 8:00am to 4:00pm. 3. The facility is secured by gates at both entrances and a portion of the facility is fenced to prevent unauthorized access. In areas where fencing has not been installed, topography serves to limit access as well. 4. Signs providing the hours of operation, the permit number and disposal procedures were observed at the scale house and the entrance to the facility. Additional directional and informational signage is posted throughout the facility to aid customers. 5. The permit and operations plan were available upon request. Operations Inspection of the MSWLF Unit (8807-MSWLF-1990) 6. The facility is currently filling in Phase 5. 7. The access roads were constructed of all-weather material and were being maintained. 8. A roll -off container containing a large amount of bagged yard trash was observed being dumped during the inspection. Facility staff also saw the banned material and removed it from the working face. 9. The working face was compact and was of manageable size at the time of inspection. 10. Litter fencing has been installed around the northeast side of the cell to help confine windblown material. 11. Windblown material was observed off of the working face; however, the majority of the material was confined to the interior of the cell and multiple staff members were picking up windblown material at the time of inspection. As stated in 15A NCAC 13B .1626(11), "At the conclusion of each operating day, all windblown material resulting from the operation shall be collected and disposed of by the owner or operator." Collect and return all windblown material at the end of each working day. 12. Tires that were removed from incoming loads were staged to the southeast of the working face. Ensure tires are placed in an enclosed trailer or covered with a water shedding material within ten days of receipt to control mosquitos and other vectors as required by 15A NCAC 13B .1107 (2)(c). 13. A damp area was observed on the north side slope. Investigate this area and make repairs as necessary to prevent the potential of leachate leaving the lined disposal area. 14. The leachate tank was inspected and found to be well maintained, the secondary containment area was clean, free of debris and the valve was closed. Operations Inspection of the Treatment and Processing (Grinding) Area 15. The facility is permitted to receive land clearing waste as defined in 15A NCAC 13B .0101(31), unpainted and untreated dimensional lumber and wooden pallets. The facility is also permitted to receive yard trash as defined in § 130A-290 (a)(45). Ground material containing yard trash may not be distributed to the public unless it has been composted in accordance with 15A NCAC 13B .1406. 16. The grinding area is located to the northeast of the active cell but is not accurately reflected on the facility drawings. However, the facility is currently working with their consultant to update the facility map. Submit the updated facility map by email to: Allen Gaither Permit Engineer allen.gaither@ncdenr.gov 17. No unapproved material was observed in the stockpile area. 18. Logs were observed down an embankment on the northwest of the side of the treatment and processing pad. These logs need to be returned to the pad area as the placement of the logs could be construed as a disposal activity.
