ADDITIONAL COMMENTS
1. CDLF facility is currently operating in Phase IV (on top of closed unlined MSWLF – Phase II). Includes post-closure care requirements for the closed MSWLF Phase I, II, and III (under Phase IV CDLF) as well as,
concrete stockpile areas, mobile home deconstruction area and 2-acre yard waste storage and processing area. A temporary Disaster Debris Site (DS83-004) is also across the path from the yard waste area but is currently NOT activated and no waste inside of it.
2. UNRESOLVED - Permit Attachment 3, Part VII, (22) - The area that is encompassing approximately two (2) acres and located at the northwest end of the landfill facility is permitted to operate a treatment and processing facility as defined in Rule 15A NCAC 13B .0101(49).
Currently the County has been able to utilize almost all the older Yard Waste (YW). Upon inspection, the two larger piles beyond the two acres were pretty much gone, although some final clean up down to soil is needed.
Erosion Control and bank stabilization across the mine, closed MSW and using as ADC 50/50 mix have been the pathways of utilizing this mulch mostly. Still some YW can go to boilers and is separated. Be sure and follow through with ADC guidance by ensuring to cover once a week with soil in addition. Mr. Lash was keeping good cover logs but should indicate when using ADC and which type or the weekly soil cover. Mr. Powell and Mr. Lash walked the YW area and measured using a laser range finder. It was determined the current area being utilized is under the 2-acre limit, however there is still waste inside the property line buffer/and ditch/swale buffer and some waste needing removed down to soil outside this area. Road cones are used to mark the two-acre approved area currently. Staff onsite are currently working on finishing removing the waste inside these buffers and cleaning up the final amounts left from the two piles beyond the 2-acre area. Closer inspection of pile windrow, when it was mostly thought to be older composted YW, but it may have some areas that are just soil. Really old and composted YW is still waste and must be removed. Be sure and remove all older YW, any soil can be left. Discussions onsite were also that once all older YW was removed, a berm of soil be put back but put on the ditch/swale buffers on north side and along roadway property line buffer. This would help ensure yard waste doesn’t make it into buffers again by a physical
barrier. Piles are built to permit specifications with breaks in windrows, good job. Small amount of unapproved waste was visible, please remove to appropriate disposal site. Mr. Powell and Mr. Lash discussed an additional 60 days to follow up address the YW onsite and come back and view all corrective actions addressed. Once City of Laurinburg can begin operation of their new permitted facility, then it will not put so much YW onto Scotland County to handle. Also, with the utilization of ADC on the CDLF 50/50 mix, this will assist in a manner for saving soil while removing YW and helping with compliance
issues in this part of the operation.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

YW mulch was awaiting to be spread in this location of Closed MSW last visit. It has been spread very thin, less than 3 inches deep, as requested.
3. Some of the bank stabilization and erosion control was done on inside of the older section of the mine down
from YW area. Clay and undesirable soil was put on inside first as a barrier to stop any mulch from eroding into water and to keep heavy rainfalls from increasing water level and causing a “waste in water” situation. Mr. Powell asked Mr. Lash about what was highest water level that could be in this mine, and he indicated it
couldn’t get high enough to contact the mulch. Be sure waste is never disposed in water.

4. CDLF working face was approaching max size, about ½ acre, and needing cover. Mr. Lash indicated that was the staff plans soon as well. There was some exposed waste on top of hill side of access road. It was coned off for being too wet from recent rains and attempts to spread cover only made ruts. When conditions allow, Mr. Lash, indicated they would cover and slope appropriately and thought that would be in next day or two. A roll off container was onsite for unapproved waste and is removed daily from working face. Mr. Lash stated he has used a lot of 50/50 ADC mix to cover. Be sure and cover with soil at least weekly as well, refer to ADC Guidance Document, to meet conditions for using ADC. Indicate ADC and what type on cover logs as well. Some small shrubs/vegetation is starting to build up in ditches surrounding CDLF/Closed MSWLF and should be removed when conditions allow. This will allow for staff to catch seeps before discharge, monitor edge of waste for erosion etc. and trees from growing along edge.

5. SWS staff reviewed records for all facilities of the following since last visit in 10/2021: Random waste screening records, monthly waste volumes for all types,2021 FAR, scrap tire forms, groundwater sampling for 9/2021, methane sampling for 12/2021 and 3/2022, cardboard recycling, septic hauler of leachate records, scale house fines, yard waste tonnages, TS assessment report and CDLF cover logs. Facility had newest copies of permits available onsite as well. Certified operators’ certifications were also available in office.

6. There were many landfill gas and water monitoring wells inspected surrounding the facilities at Scotland County
site. LFG 2, LFG 4, LFG 5, MW 4, MW 6, LFG 9, GP 6, and LFG 8 were visited. Names, with information plates and locks were visible on all. Good job. Be sure to keep a check on this. Sometimes someone who does sampling forgets and leave it unlocked or a mower may hit and damage the construction.
7. Concrete storage area currently has more than approved dimensions, but probably not more than the volume indicated. “The permittee must maintain the stockpile of inert debris with the dimensions no more than 150 feet by 150 feet by 25 feet high, approximately 10,000 cubic yards at any time.” Discussion with Mr. Lash was to investigate the total tonnage taken since last crushing and speak with a concrete crusher about
addressing this stockpile soon. Also, it was discussed that Scotland should reconsider not stockpiling concrete unless could meet this rule and not take years to stockpile enough to crush then maybe should just dispose in working face. Scotland needs to decide how it wants to move forward. If chooses to accept concrete into this stockpile, then the area should be marked off and controlled better to ensure the waste is kept in the approved dimensions and volumes approved in the permit. Waste was clean during inspection. Rule Reference: § 130A-309.05. Regulated wastes; certain exclusions. Basically says 75% of what concrete is taken must be utilized/crushed within a year.

8. Mobile Home Deconstruction area had only one to be deconstructed since last visit, according to landfill staff.
9. Electronics waste handling area was not visited but is just a storage building near gated entrance to Scalehouse onsite.
10. Corrective measures are necessary as result of this inspection. A follow up inspection will be conducted by Solid Waste Section Staff in about 60 days or sometime after. Mr. Powell is willing to continue working with the Scotland County, just please communicate well and make progress towards fixing the
issues onsite quickly. Scotland County should has made measurable progress, but more is needed in the Treating and Processing of yard waste area. Failure to meet the conditions for compliance may result in Compliance Actions.
