The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Drew Hammonds and David Powell, with the Solid Waste Section (SWS), attempted to access the Charles
Martin NLCID for a comprehensive inspection. A gate was locked on the road to the NLCID, so they did not access the landfill. Attempts to contact Mr. Martin, via phone at 910 - 673 – 1545, have failed, although voicemails were left and no return contact has been received. Section Staff, Mr. David Powell, need Mr. Martin to contact him ASAP to schedule a visit for a compliance inspection. Mr. Powell can be reached at 910 – 433 – 3350 or [e-mail]. 2. In addition, this inspection/letter, you will also find a copy of the newest rules regarding Land Clearing and Inert Debris Landfills (LCIDs) as an attachment. Also attached, is a letter sent from the NCDEQ Solid Waste Section Chief Ed Mussler, dated October 6, 2021, concerning the readopted rules and regulatory requirements for notified LCID landfills. This letter is included in case you had not received it when it was sent last year. Please contact Mr. Powell, review the new rules and the letter enclosed as soon as
