STATUS OF PERMIT:
A Permit Approval to Operate A Scrap Tire Collection and Processing Facility was issued to Ben Bryant and New
River Tire Recycling, LLC on February 4, 2019. The permit shall expire at the close of business December 20, 2024.

None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The facility consists of a Scrap Tire Collection and Processing Facility for the collection and processing of scrap
tires.
2. The facility is permitted to receive tires from all states within the United States.
3. The facility had proper signage.
4. Gates were provided at both entrances to the facility to prevent unauthorized access.
5. A chain-length fence is provided around the entire perimeter of the facility to prevent unauthorized access.
6. Phone service is maintained at the facility to assure contact with local fire protection authorities in case of fire.
7. No standing water was observed on the uncovered portions of the facility.
8. An Emergency Preparedness Manual is provided under Appendix L of the approved facility application.
9. The indoor processing area and maintenance/storage areas were protected by an overhead sprinkler system and fire
extinguishers.
10. Tonnage information will be reviewed upon submittal of the Facility Annual Report for 2021-2022.
11. All scrap tire storage areas were greater that 50-feet from all property lines.
12. It appeared that scrap tire storage piles were maintained within the permissible size limit of 5,000-square feet or
50,000-cubic feet.
13. Since the previous inspection, the remaining portions of the exiting building have been removed. Two new steel
buildings have been constructed on site. These new buildings will be used for expansion of the rubber flooring
operation only. No operations associated with the collection and processing operation will take place within the
new buildings.
14. No construction and demolition debris was observed within the facility.
15. Filter rings previously installed around storm drains located on the south side of the facility were not in place at the
time of the inspection. Failure to provide measures at these drains could result in processed material entering the
storm sewer system during rain events. Mr. Cagle explained the former filter rings broke down over time and were
no effective. Please ensure alternative measures are provided at the storm drains.
x All storm drains were observed at the time of the inspection. No material associated with the collection
and processing facility was observed within the drains. Mr. Cagle explained the drains are inspected
regularly and cleaned out if needed.
16. During the inspection, tires, rubber side walls, and pieces of wood were observed mixed with soil at the former
truck loading bay located on the south side of the concrete footprint of the operation. The previous inspection
directed New River Tire Recycling, LLC to ensure that fill in this area consisted only of clean fill material. It was
requested that all tires, rubber, and wood be removed from this area.
x During a telephone conversation on April 25, 2022 Mr. Ben Bryant explained all fill had been excavated
from the subject loading bay since the inspection. Mr. Byant explained plans are to possibly use this bay
as a loading dock in the future.
17. Please ensure a 50-foot fire lane is maintained around the perimeter of scrap tire piles. During the inspection, a fire
break was needed between the pile of aircraft tires and truck tires located along the north facing was on the west
side of the facility.
18. During the inspection, two beneficial fill areas were observed on site. Fill activities on the northwest portion of the
property were being carried out to fill in a low area. Fill activities on the east side of the property were being
carried out to provide additional parking for trailers.
x Majority of fill at the northwest portion of the property consisted of soil and broken concrete. However,
other wastes such as PVC pipe, pieces of OSB, and metal was observed mixed with soil. These items do
not meet the definition of “inert debris waste” and therefore, are not acceptable for use as beneficial fill.
x Fill on the east side of the property consisted primarily of concrete and brick. However, unacceptable
waste streams such as metal, dimension lumber, and rubber were also observed mixed with fill. These
items do not meet the definition of “inert debris waste” and there, are not acceptable for use as beneficial
fill.
x Within 10-days of issuance of this inspection report, all material that does not meet the definition of
“inert debris waste” (metal, plastic, dimension lumber, OSB, and PVC pipe) must be removed from
the site and properly disposed at a facility permitted by the Division of Waste Management.

19. Facility operations have changed significantly since the facility was originally permitted in 2013. Multiple areas
originally associated with the Collection and Processing Facility are now used for the manufacturing of rubber
flooring. As previously noted, two new buildings have been constructed on site which will be dedicated to the
manufacturing of flooring only. Therefore, please submit an updated description of facility operations to the Solid
Waste Section for review. This information should clarify facility operations and distinguish between the
collection and processing facility and the manufacturing operation. An updated site map must also be submitted.
