The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The purpose of this visit was to conduct a follow up of the Yard Waste Notification (YWN). Mr. Alders/Mr. Taylor had sent weight tickets for all waste present before this inspection. TDDS 63-008 site was deactivated on February 18, 2022 in Section records.

2. Upon arrival, Mr. Powell inspected the site, and found all yard waste had been removed from the YWN, including what was pushed into trees. In addition, it seemed soil was added, and the area was sloped much better, with grass was being established for erosion control. Good job. Site is much smaller than 2 acres currently. Small flags were marking the area, but more permanent markers could be used that will last such as large white PVC pipe. This will give a boundary for any staff working at site to know the limits of where waste should be placed.

3. Be sure and document where waste is removed to for disposal/appropriate use in future. Be sure and follow the map that was submitted regarding placement of YW, recyclable materials and any future YW debris, should the site be activated. TDDS must be activated by calling the Section before accepting any disaster debris.
4. During this process many ideas were suggested and considered as an alternative for using the YWN for periodic YW. If the Town wishes to manage YW in other ways in future and close the notification, just inform the Section/David Powell of the change, remove all waste and a closure inspection can be conducted.
5. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year.
