STATUS OF PERMIT:
A Land Clearing and Inert Debris Notification was submitted to the Solid Waste Section in January 2011. Notification
was recorded with Davie County Register of Deeds on January 2, 2011.
PURPOSE OF SITE VISIT:
Complaint Inspection
STATUS OF PAST NOTED VIOLATIONS:
1. UNRESOLVED: 15A NCAC 13B .0566(4) states: `Adequate soil cover shall be applied monthly, or when the
active area reaches one acre in size, whichever occurs first".
This past violation was cited under the previous 15A NCAC 13B .0563 LCID rules which were revised and readopted
effective January 1, 2020.
OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0566(3) states: `All waste shall be covered with no less than six inches of soil monthly, or when
the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet
unrestricted use standards for soils as defined in G.S. 130A-310.65 ".
During the inspection uncovered waste was observed over the entire working face. (see photos below) Exposed waste
was also observed on the south facing slope. This same condition was also observed during the previous inspection
conducted on 4/18/2019. There has been no apparent attempt to cover waste material since the last inspection.

2. 15A NCAC 13B .0566(2) states: "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of
three horizontal to one vertical at any time".
During the inspection, waste on the side slopes of the landfill had not been compacted. Slopes were observed steeper
than 3:1.
To achieve compliance, William Landworks Inc., must compact the waste and regrade the slopes of the landfill to a
ratio of 3:1, ensuring all waste is within the allotted 2-acre footprint. (see comment #1 below)
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The facility was recorded as allowed under 15A NCAC 13B .0563(3) for land clearing and inert debris landfills
under 2 acres in size. In viewing historical aerial photos, Google Earth and Davie County GIS maps of the
property, the fill area may have now covered over 2 acres in size since operations initiated. Any waste outside
the 2-acre footprint must be consolidated to within the original allowed footprint.

2. Waste observed during the inspection included land clearing debris (trees, stumps, limbs) and a piece of plastic
corrugated pipe on the north east side of the landfill. Remove all unacceptable waste to meet the requirements of
15ANCAC 13B .0566(1).
3. Access to the site is secured by a gate.
4. The access road into the site was in good condition at the time of the inspection.
5. 15A NCAC 13B .0563(6) requires all notified LCIDs actively operating on the effective date of the readopted
rule to either close by no later than January 1. 2026 or apply for and obtain a hermit for continued operations.
Because this facility is already at its maximum footprint of 2 acres, either initiate closure in accordance
with 15A NCAC 13B .0567 or submit a permit application to the Solid Waste Section. For questions
