Shannon, NC 28386 PARTICIPANTS: David Powell, NC DEQ, Solid Waste Section Jeremy Hunt, Hunt NLCID STATUS OF PERMIT: Notified LCID – N1091 front; N1111 back; PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow up STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Concrete crushing and separating is needed, this was mentioned before in a previous inspection. Section staff explained 75% rule (§ 130A-309.05. Regulated wastes; certain exclusions) and the need for material to be removed otherwise it becomes disposal. Basically 75% of the material should be recycled within a calendar year of when its first received. This needs processing or removal in very near future. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 9 N1091 1. Front NLCID had a small working face and no unapproved wastes were visible while onsite. Plastic bags in photo were from a hauler dumping leaves onto working face and the bags were not left on the LCID. 2. There was good cover and some side slope work had been done, but more is needed. ALL side slopes and waste should be inside the 2-acre notifications Edge of Waste (EOW) boundaries and marked so the corners and waste boundary can be determined. PVC pipe was put over current EOW markers, so they were easily visible, and couple added thank you. Be sure all waste/soil cover is inside the 2 acres marked onsite. Pull back any waste/soil, then cover to meet 3:1 slope. Some erosion rills can be fixed with decreasing the steep slopes to 3:1, otherwise please address when conditions allow. Please address by next follow up visit. Road access was in good shape. Working face, combined with exposed waste around sides was at or above an acre. Begin covering appropriately and sloping all sides to 3:1. Some was done but all sides slopes need to be 3:1. No unapproved wastes were visible. View of from south side of NLCID. Close up of same south side slope. Needs slope better 3:1 and cover. Last visit in 2/1/2022, along north side waste was slightly beyond the markers, but all the areas were not being utilized along the south side, So Mr. Hunt felt he was under the 2-acre limit. Mr. Hunt was requested to pull waste back inside and fix EOW markers so waste was being put into proper 2-acre place and buffers could be measured to ensure they were being met along with size of no larger than 2- acre notification. Mr. Hunt had a surveyor come and remeasure proper placement of waste/markers. Mr. Hunt indicated he discovered he was beyond his 2 acres and into the 100 ft property buffer slightly. He installed additional EOW markers and began moving that waste back inside 2-acre notification, while giving himself an additional few foot for the buffer to property lines. Mr. Powell used a laser range finder to confirm proper spacing of some of the EOW markers and they were approximately 295 ft for determining size of NLCID. Some waste was still beyond EOW and should be disposed inside the 2-acre notification EOW immediately. Waste along access road to working face also need cover and sloping 3:1. Be sure to keep all waste and cover, after proper sloping, inside the 2-acre notification. NW corner, along north side. Pull back cover and slope inside EOW. Discussions onsite were about corrective actions onsite. Mr. Hunt has submitted for a permitted LCID. Rules for LCIDs and the “75% rule” ((§ 130A-309.05. Regulated wastes; certain exclusions) was emailed to Mr. Hunt on 4/22/2022 for reference. Mr. Hunt indicated he will provide the land surveyor information on both NLCIDs from when he had the markers checked/corrected, via email when they are sent to him. Ming Chao is the Permitting Engineering Project manager for Cumberland County now and can assist you through permitting process. His contact info is - (919) 707-8251, ming.chao@ncdenr.gov. 4. Follow up with Cumberland County on your needs and intentions with your application for a permitted LCID. Recent email conversations between County and the Section seem to not reflect onsite discussion with Mr. Hunt and his plans. This can help ensure things are on track and correct. Forward the info., once approved, to Mr. Chao to continue application process. 5. Corrective measures are necessary as a result of this inspection and should be complete within 30 days’ receipt of this inspection report. A follow up will be conducted around that time or shortly afterwards to confirm. ALL issues need addressing by this timeframe.
