PURPOSE OF SITE VISIT: Partial Inspection – Fire at Yard Waste Notification on 3/26/2022
STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0105 - (a) The solid waste collector shall be responsible for the collection and transportation of all solid waste to a solid waste management facility that is permitted by the Division. (Referenced in Permit Attachment 3, Part VI, 2).

2. 15A NCAC 13B .0105 - (b) The solid waste collector shall transport to a solid waste disposal site or solid waste management facility only those solid wastes that are allowed by the site or facility permit. (Referenced in Permit Attachment 3, Part VI, 2).
3. Permit Attachment 3, Part VI, 4 - According to Rule 15A NCAC 13B .0401(c), the waste collected at this transfer facility is not subject to service area restrictions unless otherwise prohibited from accepting waste by local ordinance. The waste that is collected for disposal must be transported to a sanitary landfill facility which is: a. Permitted to receive the type of waste specified, and; b. Whose service area includes the origin of the waste as identified by franchise or local government approval.
Upon visiting and discussing the new yard waste management site, currently in the permitting process for an ACI (Air Curtain Incinerator) with composting and treatment/processing, it was discovered that Richmond County has been disposing of C and D comingled waste to build up the side of the hill behind the main office next to container storage area. Upon further discussion with Mr. Leggett and investigation of the waste, it was
determined to be sourced from the Transfer Station. The waste consisted of clean brick and block, painted brick and block, asphalt, metal, plastic, wood, clothing and electrical appliances etc. This is NOT an approved activity or storage area for these waste types and the Station waste should not have been separated and recycled for this purpose. This activity is not mentioned in the approved Operations Plan August 2021. That operations plan states, “Conducting waste recovery / recycling activities on the tipping floor is prohibited except for removal of non-conformance or prohibited wastes.” All waste is to be stored according to rule and disposed of in a landfill for that waste type. According to Mr. Leggett, some of this area had previously had beneficial fill years ago. All waste should be removed back until clean brick and block from previous beneficial fill is confirmed, photos should be taken and provided. Reminder, no fill activity shall contravene groundwater standards. Any leachate should be managed onsite using best practices and not allowed to discharge. Be sure and document those loads for disposal and provide them to the Section. Clean brick and block means it has no paint, coatings, sealants or treatments on or in the material. Be sure and review the beneficial fill rule 15A NCAC 13B .0562, changed on January 2021, emailed to Mr. Leggett on 3/31/2022.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The purpose of this inspection was to visit the yard waste area after a fire was reported on 3/26/2022. Transfer Station Permit has a yard waste section while that area is mostly addressed through its yard waste notification YWN-77-001. Mr. Powell with the Section was notified by Mr. Leggett and the notification form submitted.
Yard waste area is still smoldering and smoking, although contained, and had local fire departments and forestry respond to manage it. The clean pallet waste and the mulched pallet waste was not burned. According to Mr. Leggett, winds added to the intensity and made it spread to other piles easily through sparks. Yard waste
area will be addressed in the YWN inspection report for YWN-77-001. 2. The facility is permitted to receive solid waste generated within Richmond County. Waste is transferred to Uwharrie Environmental Regional MSW Landfill for disposal. The tipping floor was not visited due to time constraints. Mr. Powell forwarded Mr. Leggett the Beneficial Fill rule .0562 on 3/31/2022. 3. A new Temporary Disaster Debris Site (TDDS) site was close to being finalized last year. Mr. Leggett is still awaiting the Sections requested documents for crossing over the railroad structure/gas line and property during the event of an emergency and the site becomes activated to receive waste. Please continue to follow up and get the requested information and submit ASAP. 4. Corrective measures are necessary as result of this inspection. Failure to meet the conditions for compliance may result in Compliance Actions. A follow up inspection will be conducted in approximately 30 days from receipt of this inspection and further time can’t be given if satisfactory progress has been
made and additional time is requested.
