PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0566 (3) – RESOLVED 15A NCAC 13B .0566 (7) – RESOLVED 15A NCAC 13B .0566 (8) - RESOLVED OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. This facility is a land clearing and inert debris (LCID) landfill owned and operated by the City of Hamlet. 2. Section staff met with Public Works Director Billy Stubbs at the LCID for a follow up inspection on the previous inspections violations. Mr. Stubbs and Mr. Powell walked the LCID during inspection. 3. Working face was small and compact. The exposed areas that were present before are now covered well with additional soil staged for cover in future. Sides were sloped well too. Good job. Be sure and vegetate unused areas and if going to not be used for several months they may require additional soil cover according to permit/rule. Be sure and review permit for these requirements. Unapproved waste was not visible but a large container was available for unapproved wastes as they are discovered. Good job. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 5. Roads allowed for staff to enter and go on top and around, improved from last visit. However, please be sure and make it so roads go around perimeter of cells for access and fire fighting should it be needed. 6. Water was not impounded over waste. There are still some low areas Mr. Stubbs is filling and working on slope so that it will shed stormwater and not hold water over waste. Please continue as working face moves around and waste is added to LCID. Good job. 7. EOW (Edge of Waste) markers were added and visible on four corners. However, along side of railroad tracks it was measured with a laser range finder and was very close if not inside the 100 ft buffer. It should be noted there was some vegetation in the way and it was not measured straight but approximated. Please have this side checked to ensure the EOW markers represent the correct placement and are not inside the buffer to property line of the railroad property. It would be good to buffer your work in addition to what’s minimum required to ensure no problems as you build the LCID in future. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 5 8. Onsite discussions were on adding to road and continue filling low areas. In addition, confirming the proper placement of the EOW markers on the side along the railroad property line. That should be done, and confirmation emailed to Mr. Powell. If the City gets an Engineer/Surveyor/Consultant to confirm corner marker buffer/placement, forward any documentation. A photo/report on what has been changed or confirmed will suffice. Main goal is to ensure proper placement of the markers and where waste can be disposed in the LCID.
