The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS:
01 - Life of Site Permit was issued 2/20/2017 as a combined permit with facility #2803- CDLF. Facility is permitted to receive waste from Dare Co. only, passed by the Dare Co. Commissioners on August 02, 2004. MSW is transferred to 0803-MSWLF in Bertie Co.
02 - Facility has required signage. Locking gates and fencing for security. 03 - Interior roads are of all-weather construction and well maintained. 04 - The tipping floor areas indicated in the self-assessment were as stated and in need of re-surfacing.
05 - The west side of the tipping floor also was holding ponded leachate that can’t drain into the leachate drain system unless it is pushed or wash into the system.
06 - Push walls looked good as stated in the self-assessment. 07 - Some exposed rebar was noted on the corners of the entrance and exit of the loading bays. 08 - Leachate tanks have plenty of storage.
09 - The leachate drains could use attention. Not currently overflowing, but has the potential to stop up with the amount of trash in them. More cleaning is needed to prevent a potential overflow from the drains outside the leachate collection system. 10 - No leaking loaded trailers were noted during this inspection. 11 - All loaded trailers had netting style tarps on them to help with windblown trash. 12 - Staff was picking up windblown trash inside and outside of the chain link fence. Also windblown trash was being removed from the drainage ditch outside of the chain link fence. 13 - Scrap metal / White goods area was looked for potential relocation.
14 - Diana Felix, NCDEQ-SWS-Permitting Section Engineer, will be making an assessment of the findings during this inspection. 15 - A comprehensive facility compliance inspection will be conducted in April or May, 2022.
