PURPOSE OF SITE VISIT: Routine Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. David Powell with the Section inspected the Triple “A” Hauling Transfer station for routine inspection and to confirm if station was inactive/closing. Gate was open upon arrival and Mr. Powell contacted Kenny Hardin, owner, and informed of his presence and intent to inspect the station. Mr. Hardin gave permission to enter and indicated his station has been closed, equipment sold and site not accepting waste since June 2021. Mr. Powell discussed closing the station with Mr. Hardin and sent him copies of new Transfer Station rules/Ming Chao’s (Permitting Engineer assigned to Cumberland County) contact information later on 3/31/2022 via email. Mr. Powell encouraged him to speak with Mr. Chao on closure requirements. Mr. Ming Chaos can be reached at (919) 707-8251 or ming.chao@ncdenr.gov. 2. This Transfer Station has not submitted the required Transfer Station Assessment Report in accordance with 15A NCAC 13B .0401, but Mr. Hardin stated on phone call during inspection, and other times, he intended to close the Station and it seems this has occurred. Front signage has been removed as well. Transfer Station closure requirements are found in 15A NCAC 13B .0406. Some of the dates listed in this rule for closure, Mr. Hardin may already be beyond if the site was closed June 2021. Mr. Chao requested from Mr. Hardin on 3/31/2022 that he submit a closure report including cover page containing facility name, permit number, contact info including phone #, e-mail address, physical address; the date stop receiving wastes, and the date of cleanup the site. Once rule .0406 requirements have been satisfied and that information provided to the Division, a final inspection needs to be done to confirm closure to rule. Roll off containers left onsite, and the ones that were checked, were empty of waste. Roll off container, ones that were checked were empty during inspection. 4. Station had only a few piles of waste onsite, from what seemed to be clean up activities. Some was wood chip comingled waste, painted pallet pile and a couple others were a mixture of windblown and C and D waste comingled with rock and soil from surrounding areas of conveyor/tipping floor. Windblown was minimal on south east side but still some need removal. Please document waste removal. C and D waste, mostly block and soil, but other waste such as aluminum cans wood products etc., beside tipping floor of concrete pad. In center of station. Current tipping floor. Documentation will be submitted with closure information. 6. Corrective measures are necessary as a result of this inspection and should be completed within 30 days’ receipt of this inspection report. Mr. Hardin should communicate with Mr. Chao and Mr. Powell on progress and submit required documentation within this time frame as well.
