The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The purpose of this visit was to follow up on the NLCID/IS782201 corrective actions based on receiving contact from Chris and Daniel Parker that all corrective actions were completed early. Upon arrival it was apparent much had been done to both the IS782201 and the notification. Good job. There was some miscommunication before, and a little work is left to be done before all violations can be resolved and the notification can start accepting waste again.
2. Once onsite, Mr. Powell met with Mr. Chris and Mr. Daniel Parker, whom all walked around the NLCID and the illegal site. Erosion control fence has been installed around NLCID and the illegal site. NLCID has been hydroseeded as well. Good job. Recent rain has eroded side slopes which need re-sloping and cover. Mr.
Powell took measurements with measure wheel around the NLCID.

3. Measurements for the west side of NLCID were ~ 320 ft., west side ~175 ft, south side being ~ 410 ft and east side ~ 300 ft. That would give the notification a dimension of approximately ~ 2.00 acres. However, it is unsure if property line buffers are being met. The Parkers had a surveyor come and measure the size and assist with inputting EOW markers in on the correct corners. Markers were added, 2x4 lumber posts, were installed. More permanent EOW markers should be installed that wont rot away so easily in couple years. Property lines were not marked as requested during last inspection. Please mark property lines around NLCID so that buffers can be measured. Discussions onsite with Mr. Daniel Parker and Mr. Chris Parker, were to get the property lines marked and EOW markers put in place so upon follow up inspection, Section staff can determine if these buffers are being met according to rule. All waste outside of 2-acre notification should be brought back inside of the 2 acres’ notification, buffered from property lines 100 ft., covered, compacted and sloped 3:1. LCID waste only from the surrounding illegal dump may be disposed of inside of the NLCID, if there is room.
4. Trees and shrubs were also removed from side slopes. Good job. Side slopes are too steep on West, South
and North sides in many areas. So, find out property lines then buffer 100 ft, then pull back anything that is outside of that area back inside. Cover and slope all sides. It seems removing road to top of NLCID was a misunderstanding during last visit. If going to continue to dump, in future, the NLCID will need road
access to top and Section staff need access to inspect. Should be of all-weather construction.

5. Waste still along north side of illegal site. Along the north side has a higher elevation, some due to waste and some do to lay of the land it seems. All vegetative wastes should be removed. If it is older, composted or rotted, it is still waste and is not approved for disposal at this property. Several big limbs, logs and chunks have rolled downhill into trees. Unknown depth of waste along erosion control fence as well. All need removal and proper disposal.

6. Last inspection stated, “Any open dug holes that had waste during inspection should be left open to confirm waste is not being buried in place. Take appropriate safety measures for open pit. Waste shall not be disposed in water, please remove from mine. Communicate with Division of Energy Mine and Land Resources (DEMLR)
at (910) 433- 3300 about any requirements for Sedimentation Erosion Control and mining etc. Pine logs were brought in and set aside for sawmilling. If going to be milled, then proceed otherwise they are waste and should be disposed of appropriately.” Holes where waste was dumped previously, have been filled. This area needs 2 or 3 places, in same area, excavated again and checked by Section staff, to ensure no waste was buried. This can be done during follow up inspection.

7. All unapproved wastes seemed to have been removed and disposed at the appropriate disposal site. Documentation was provided to Section, weight tickets from Robeson County LF. Road access around the NLCID is now available. Good job. Be sure “access roads shall be of all-weather construction and shall be
maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles.”
8. Discussions were also on potential assistance companies that can assist with permitting. Mr. Powell suggested communicating with other permitted LCIDs’ to see whom can assist and who has experience with Land Clearing and Inert Debris landfill/NC state Rules regarding Solid Waste etc. Section staff cannot promote one firm or another, which Mr. Powell explained.
9. The site must cease all dumping operations until corrective actions have been completed and confirmed by representatives of the Section. Additional time may be necessary and if so, communicate with Mr. Powell (910) 433-3350. Documentation of waste disposed other than the 2 acre notification should be emailed to Mr. Powell ASAP at david.powell@ncdenr.gov.

diana.felix@ncdenr.gov. This site shall be in compliance before being permitted.
11. Corrective measures are necessary as a result of this inspection. Previous inspection sent on March 17, 2022 gave 60 days from that date sent, which would be May 16, 2022. This should still be enough of a timeframe for the last corrective actions. A follow up will be conducted around that time or shortly afterwards to confirm. If completed beforehand, communicate with Mr. Powell and he can schedule a follow-up as soon as possible to confirm corrective actions complete.
