The site is recorded in deed book 8752, pages 533-548. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please read through the rules and contact me if you have any questions. Based on rule 15A NCAC 13B .0563 (6), within 5 years of the effective date, all notified LCID landfills will need to be properly closed or will need obtain a permit from the Division of Waste Management. 1. Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff and fire -fighting equipment. The site was very wet and muddy due to recent rain. The entrance road to the site was of all-weather construction. Some Trackout Control Mats have also been installed at the facility to help reduce the tracking of mud outside of the facility. At the time of this inspection, the entrance roadway was being excavated so that a concrete driveway could be poured. 2. The sign at the entrance to the landfill is installed and posted as required. 3. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Section .0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be of height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers are visible when standing at a marker." Edge of waste markers were not visible during this inspection. Permanent, clearly visible edge of waste markers must be installed at this facility, showing the under two -acre disposal boundary. 4. At the time of this inspection, uncovered waste was observed in several areas of the facility. Along the western side slope. The active working face was identified along the eastern edge of the LCID. Several piles of uncovered inert debris were identified on top of the southern portion of the LCID. Ensure that all waste is covered with a minimum 6-inches monthly or when the working face reaches one acre in size, whichever occurs first. 5. The operator shall maintain a 100 feet buffer from the waste boundary to property lines, residential dwellings, commercial or public buildings and potable wells. Waste had been pushed into the tree line near the southeastern corner of the LCID. The waste needs to be removed from the tree line near the southeastern corner. The EOW and property lines of this facility are to be marked and identified so that it is clearly visible during inspections of this facility. Any waste within the buffer must be pulled back and placed within the limits of the NLCIDLF. 6. The waste stream was observed to be relatively clean. A load containing several pieces of painted concrete, dimensional lumber, and metal had been dumped at the top of the LCID. Mr. Johnson stated that he had already contacted the offending dumper and they were supposed to be removing the waste from the landfill. Ensure that unacceptable wastes are removed and properly disposed of promptly. 7. 15A NCAC 13B .0566 (8) states, "Surface water shall be diverted from the working face and shall not be impounded over waste." At the time of this inspection, several areas of standing water were observed impounded over waste. The area had received heavy rain that morning. When conditions allow, the areas need to be graded to promote positive drainage of surface water away from the top of the LCID. 8. 15A NCAC 13B .0566 (2) states, "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time." The accessible side slopes were identified to be steeper than a ratio of three horizontal to one vertical. Ensure that the side slopes do not exceed a ratio of three horizontal to one vertical. 9. At the time of this inspection, a large crack was observed near the southern side slope. The southern side slope appeared to have shifted and could fail. The area needs to be carefully repaired so that the southern side slope does not fail and slough off into the sediment basin. 10. Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to public health or a nuisance to the community. 11. Erosion control measures, structures or devices shall be utilized to prevent silt from leaving the site and to prevent on -site erosion and shall comply with 15A NCAC 04. 12. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." The eastern side slope was overgrown with vegetation and could not be accessed via vehicle. 13. A mine for cover soils was observed along the eastern side slope. The slopes of the mine need to be stabilized and sloped to a ratio of three horizontal to one vertical. 14. Digital pictures were taking during the inspection. 15. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
