Resolved: 15A NCAC 13B .0203(d). On January 25, 2022, Garbage Pal, LLC was cited for leaving waste on the tipping floor after operational hours. On March 25, 2022 at 6:30 am, an inspection of the treatment and processing facility was conducted prior to the start of the operating day to ensure all waste was removed from the tipping floor at the conclusion of the previous as required by the Permit to Operate, Part IV: Transfer Station/Treatment & Processing Unit(s), 20(b). During the inspection the tipping floor was observed to be clear of waste and in a clean and sanitary condition. Therefore, the violation is resolved. B. Resolved:15A NCAC 13B .0203(d). During the inspection the tipping floor was observed to be clear of waste and in a clean and sanitary condition. Therefore, the violation is resolved. OBSERVED VIOLATIONS: No New Violations Observed The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken on March 25, 2022 by Lee Hill. 2. On March 25, 2022 at 6:30 am, an inspection of the treatment and processing facility was conducted prior to the start of the operating day to ensure all waste was removed from the tipping floor at the conclusion of the previous as required by the Approved Operations Plan and the Permit to Operate, and no waste was observed on the tipping floor (see Status of Past Observed Violations section of this report for more information). 3. The leachate trench drain located in the center of the tipping floor appeared to be packed with grit and soil. Facility staff started cleaning and removing material from the trench drain during the inspection. Ensure that the trench drain is maintained daily so leachate is properly managed. 4. No unapproved material was observed in the material stockpiles to the west of the treatment and processing building. 5. Windblown material was well managed at the time of inspection.
