OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0203(d) states `By receiving solid waste at a permitted facility, the permittee shall be
considered by the Department to have accepted the conditions of the permit and shall comply with the
conditions of the permit." The Permit to Operate, Attachment 4, Conditions for Closure, Part I: General
Facility, 3. states Brushy vegetation and trees are prohibited on the landfill cap. Brushy vegetation and trees
with trunks less than a six-inch diameter breast height (DBH), measured using standard forestry practice, can
be mowed, or removed using appropriate methods, without approval from the Section. Trees with a trunk
greater than six inches DBH require development and submittal of a tree management or removal plan.
Polk County is in violation of 15A NCAC 13B .0203(d) in that several small trees were observed
growing on the northern, northeastern and southwestern sides of the landfill cap. All of the trees on the

cap appeared to be less than six inches in diameter at breast height. Brushy vegetation was also
observed on the southwestern side of the landfill cap.
To correct the violation, Polk county must submit a Tree Management Plan to the section within sixty (60)
days from the date this report OR remove all woody and brushy vegetation from the cap within one hundred
eighty (180) days of the date of this report.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on March 11, 2022 unless otherwise noted.
2. The closed landfill is located to the northwest of the Polk County Transfer Station (7504T-TRANSFER-2005).
3. A closure plan was submitted to the section on August 21, 2006, and closure, in accordance with Rule .0505,
was certified in June 2007. The closure permit for the landfill was issued on December 9, 2015 under permit
number 7504 (DIN 25344).
4. Semi-annual groundwater monitoring was conducted on May 11-13, 2021 and October 5-7, 2021, and the
results were submitted to the section for review.
5. Several small trees were observed growing on the northern, northeastern and southwestern sides of the landfill
cap. All of the trees on the cap appeared to be less than six inches in diameter at breast height. Brushy
vegetation was also observed on the southwestern side of the landfill cap. Remove woody and brushy
vegetation from the landfill cap. See Observed Violations Section of this report.
6. The cap had good vegetative cover and no erosion issues were observed. Facility staff stated the cap is mowed
twice per year.
7. No indication of subsidence or settlement which would cause impounding of water on the cap were observed.
8. Edge of waste markers constructed of PVC pipe are installed around the footprint of the landfill. However, it
appears that some of the markers on the northwest and west side of the landfill have been damaged and are not
visible. Repair or replace the damaged edge of waste markers as needed.
