Parkton, NC 28371 PARTICIPANTS: Chris Parker, Parker and Sons Daniel Parker, Parker and Sons Heather Parker, Parker and Sons Ashley Parker, Parker and Sons David Powell, SWS Drew Hammonds, SWS STATUS OF PERMIT: N1027 – Notification originally 2009 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0566 (1) - The site shall only accept those solid wastes that it is permitted to receive. 2. 15A NCAC 13B .0566 (2) - Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 3. 15A NCAC 13B .0566 (3) - All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. Upon inspection of the NLCID, it was discovered that the side slopes were steeper than the required 3:1. In addition, there was a lot of waste uncovered and uncompact on the sides and top of the NLCID. Unapproved wastes, such as metal pipe and treated dimensional lumber, were also present. Road access was limited and should be improved to be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles. Unapproved wastes should be removed to appropriate disposal site and documented provided to Section. Waste is beyond 2-acre notification and inside property line buffers. All waste should be brought back into appropriate buffers, inside 2-acre notification, covered, compacted and sloped 3:1 appropriately to rule. Unapproved waste, metal pipe and treated dimensional lumber, on top of NLCID at working face and uncovered. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 7 ADDITIONAL COMMENTS 1. The purpose of this visit was to conduct a Comprehensive Inspection of the NLCID. Upon arrival it was determined that there was an illegal dump, IS782201, behind and around the previously approved NLCID N1027 Parker and Sons. Notice of Violations to follow for Illegal site and NLCID. New LCID rules were emailed during site visit to Mr. Parker. Mr. Parker indicated his dad and owner, Dwayne Parker, has retired and himself and Mr. Daniel Parker are operating business currently. Looking at NLCID from illegal site. 2. Once onsite, Mr. Powell met with Mr. Chris Parker. After some time and looking for notification paper work at NLCID office, Mr. Powell was joined by Mr. Hammonds and eventually, Daniel Parker. Later all met at office with Heather Parker and Ashley Parker. They represented A-1 Landscaping & Lot Clearing, Inc., Parker and Sons NLCID and landowner Mr. Dwayne B. Parker. 3. Mr. Hammonds and Mr. Powell walked site and took measurements of illegal site and surveyed conditions on and around the NLCID, with Mr. Chris and Mr. Daniel Parker onsite. 4. Waste in illegal dump, north of NLCID has evidence of burning solid waste, with some still smoking during inspection. Although this isn’t in the NLCID, burning of solid waste is prohibited in the NLCID for future reference. 15A NCAC 13B .0566 (10) (a) - Open burning of solid waste is prohibited, unless approval has been obtained from the Division, the local government, and the Division. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 7 5. Measurements for the west side of NLCID were ~ 369 ft. and the south side being ~339 ft. That would give the notification a dimension of approximately ~ 2.87 acres. Waste is beyond the limit of the original 2-acre notification. It is unclear if waste is inside of buffers but appears so as well. Waste is close to several property lines on the sides. Discussions onsite with Mr. Daniel Parker and Mr. Chris Parker, were to get the property lines marked and markers put in place so upon follow up inspection, Section staff can determine if these buffers are being met according to rule. All waste outside of 2-acre notification should be brought back inside of the 2 acres’ notification, buffered from property lines 100 ft., covered and compacted and sloped 3:1. LCID waste only from the surrounding illegal dump may be disposed of inside of the NLCID if there is room. All unapproved wastes should be removed and disposed at the appropriate disposal site for that waste type and documentation kept/provided to Section. 15A NCAC 13B .0564 (6) (b) - 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells. 6. Edge of Waste (EOW) markers around the corners of the NLCID should be put in place once the correct corners of the 2-acre notification are determined. One should be visible to the next. Suggest large tall white PVC pipe. This will assist in measuring size of the notification and distance to buffers. Trees/shrubs should be removed from NLCID as well. 7. Any open dug holes that had waste during inspection should be left open to confirm waste is not being buried in place. Take appropriate safety measures for open pit. Waste shall not be disposed in water, please remove from mine. Communicate with Division of Energy Mine and Land Resources (DEMLR) at (910) 433- 3300 about any requirements for Sedimentation Erosion Control and mining etc. Pine logs were brought in and set aside for sawmilling. If going to be milled, then proceed otherwise they are waste and should be disposed of appropriately. North side of NLCID with sawmill logs as bottom of slope. Property line somewhere on left side of frame needing to be marked. Remove and dispose at proper disposal site if not the NLCID. No waste shall be in water. Leave hole open to confirm no burial on follow up inspection. 8. Division of Energy Mine and Land Resources (DEMLR), Division of Air Quality (DAQ) and Robeson County Solid Waste Section will be notified of findings onsite for NLCID and illegal dump activities. Representatives from these groups may contact you or visit the site as well and have their own requirements. 9. The site must cease all dumping operations until corrective actions have been completed and confirmed by representatives of the Section. A timeframe of approximately 60 days was agreed to be done with corrective actions from date the inspection will be sent to be complete with corrective actions. Additional time may be necessary and if so, communicate with Mr. Powell (910) 433-3350. Documentation of waste disposed other than the 2 acre notification should be emailed to Mr. Powell ASAP at david.powell@ncdenr.gov. 10. Mr. Chris Parker stated the cleanup would be made a priority and they would like to pursue a larger permitted LCID. The Section Permitting Engineer for this county is Diana Felix, and she can be reached at (919) 707- 8257 or diana.felix@ncdenr.gov. This site shall be in compliance before being permitted. Corrective measures are necessary as a result of this inspection and should be complete within 60 days’ receipt of this inspection report. A follow up will be conducted around that time or shortly afterwards to confirm. If completed beforehand, communicate with Mr. Powell and he can schedule a follow-up as soon as possible to confirm corrective actions complete.
