PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow Up STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 ADDITIONAL COMMENTS 1. Reason for visit was to inspect YW area. Facility is gated and has signage out front for Transfer Station, in which YWN is a part of LOS permit. Don’t forget to submit renewal by first of June each year. 2. During last inspection it was determined that yard waste was being composted in basically 4 windrows with a clean wood pallet windrow separate from the YW. The waste is moved by Simmons and Simmons, transported to Old Castle” to compost into soil. A document was provided from Simmons and Simmons, to Richmond County, that stated approximately 2000 tons of waste had been removed to Oldcastle Lawn and Garden in Aberdeen, NC and Pageland, SC in December 2021. Waste also is removed to a boiler when accepted. However, there is still a large amount of older YW and newer waste just ground by Simmons and Simmons windrowed onsite. Also during last visit, it was determined that waste piles had been placed too close to swale/ditch buffers. It was stated, “Pallet grindings up front and compost in back of the windrow areas were too close to swales and should be moved back away from them. A 25-foot minimum distance shall be maintained between compost areas and swales or berms.” Edge of Waste (EOW) markers showing the limits of the working area, with respect to buffers were requested as well. Mr. Leggett, in the meantime, provided measurements and an overhead map explaining the limits of the site and its activities, showing it utilizes approximately 1.65 acres, which is less than the maximum 2 acres. During the 2/22/2022 visit, Mr. Powell and Mr. Leggett walked the perimeter of the yard waste area. Waste has been removed as requested, just not enough and additional new waste was discovered this visit. Unapproved waste was at a minimum but some was visible from recent corrective action work, please remove to appropriate disposal site. Given the time of year and recent work in this area, it was easier to see into surrounding vegetation and surrounding areas. What was thought to be soil was in fact older waste that had been compacted and vegetation overgrowing. Some older waste was visible in swale and inside the buffer, although much work had been done, it only helped to show there was additional waste in these areas such as some pallets, older log chunks, and older composted waste. EOW markers were installed but should be moved to reflect the appropriate working/staging/processing areas that are outside of the 25 ft. buffers from swales and ditches. Older waste, even though it may be broken down into a soil consistent substance, is still waste and should be removed according to rule. There is much buildup of the older broken down waste around the East, South and SW perimeter sides. Waste that is stockpiled and windrowed may also have this older waste underneath and should be removed until down to soil if this is in fact. This will be a larger undertaking than was previously thought in previous inspections. Much progress has been made in removing the YW but these older wastes should be removed down to soil and the area built back correctly. Reference 15A NCAC 13B .1404 SITING/DESIGN REQUIREMENTS FOR SOLID WASTE COMPOST FACILITIES for Small Type 1 YWN’s. Please document these activities and where all waste is utilized or disposed. Later discussions were for using the waste on the Closed MSW for erosion control to maximum depth of 3 inches. This waste cannot be buried or used for fill. This can be mixed with soil for ADC at a landfill or disposed of in landfill or used around county such as for beautification in flower beds etc. Compost facilities permitted for this waste type may also be willing to accept the older material. Reminder, it must meet 1400 rules if given to public or ends up with the public. A time line of approximately 60 days from the receipt of this inspection was given for addressing the unapproved wastes and wastes in the swales/ditches. Older mulched/composted waste is deeper here and has built up for years. Swale and ditch buffer is in back of the YW area and background of this view. This area just has a deeper amount of built up older waste that should have been removed. Some older big chunks of wood waste have rolled down hill, out of view and near ditch, in this area needing removal as well. 3. Don’t forget Transfer Station rules for this area as well as .1400 rules for YWNs. It is suggested to keep smaller windrows for easier management, firefighting equipment access and less risk of ignition when it is composting. Check with your engineer/consulting firm on how to manage. Access roads should be of all-weather construction and should be fixed around perimeter for this are once down to soil and it is repaired. Transfer Station Permit Attachment 3, Part (7), 21 - The permittee must store or stockpile the received waste or processed/ground material (such as mulch) in the following manner: a. Each windrow has the maximum height of 30 feet and the width of 50 feet at any time. b. Each windrow shall be maintained at least 25-foot clear distance or perimeter from drainage ditches and swales, around the processing area, and other stockpiles of raw wastes and ground material to allow for inspection, monitoring temperature, or firefighting. c. Each windrow shall be maintained at least 50-foot clear distance from property boundaries. 15A NCAC 13B .1406 (5) (c) - The access road to the site shall be of all-weather construction and maintained. 4. DEACS, Department of Environmental Assistance and Customer Service 1-877-623-6748, may could find a use for this waste type to be recycled. In the event waste cannot be removed, then the County should consider altering its services of accepting pallets until this problem is solved and the waste removed. Consult also your engineering firm/consultant for ideas and check with the Sections Permit Engineer, Ming Chao, for approval on that plan before putting into action. I believe given the onsite and after inspection discussions many uses were available to the County to follow up and utilize this waste according to rule. Failure to meet the conditions for compliance may result in Compliance Actions. A follow up inspection will be conducted in approximately 60 days from receipt of this inspection and further time can’t be given if satisfactory progress has been made and additional time is requested.
