On March 1, 2022, ATC mobilized to the site, to complete one soil boring (SB-1) in the
vicinity of former Dispensers 9/10. Soil samples were collected from 5 ft-bgs and 10 ft-
bgs. The samples were submitted for full risk -based analysis, including EPA Methods
8260D and 8270E for Volatile and Semi -volatile Organic Compounds (VOC/SVOC), and
MADEP EPH and VPH for extractable and volatile petroleum hydrocarbons. The
laboratory analytical report indicates neither of the soil samples contained VOCs, SVOCs,
EPHs, or VPHs at concentrations above laboratory detection limits.
I will issue a No Further Action letter for the site this morning. There will be no
restrictions on the property since sample results were below laboratory detection
limits. The property can convey at any time since there will be no deed restrictions.

Carrie — The report is due by March 8th. The responsible
party or their representative can request an extension if
an appropriate explanation is provided. A Notice of
Violation (NOV) letter will be issued if the report is not
submitted within the required time period and an
extension has not been granted. The notice will allow
the responsible party 10 days from the NOV letter date
to respond with an explanation of why actions have not
been taken. Procedures toward possible enforcement
action recommendations would be started if there is no
response to a Notice of Violation letter. This is a
stepped procedure and possible enforcement actions
do take time.

Thank you for the info. I know they haven't done
anything on -site. As I mentioned before, Circle K
poured new concrete once the tanks, canopy and
pumps were removed. Are they not required to do
the clean up?
