1. A Notice of Violation (NOV) was issued on February 11, 2022 for violation of 15A North Carolina Administrative Code (NCAC) 13B .0841(e)(1) because leachate was allowed to flow uncontrolled into a storm drain.
During the inspection on March 2, 2022, an additional spill of septage was observed on the ground at the truck offloading area therefore the violation is not resolved. 2. A Notice of Violation (NOV) was issued on February 11, 2022 for violation of 15A North Carolina Administrative Code (NCAC) 13B .0837(m) because permit number SDTF-34-02 issued to Environmental Relief Technology, Inc. was scheduled to expire on March 1, 2022 and an application for renewal has not been received at least 90 days prior.
On February 25, 2022, a permit application for the renewal of permit number SDTF-34-02 was received. The violation is resolved.

OBSERVED VIOLATIONS:
1. 15A North Carolina Administrative Code (NCAC) 13B .0841(e)(1) states: “Each detention and treatment facility
shall be designed, constructed, and maintained in such a manner as to prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters.” Environmental Relief Technology, Inc. was in violation of 15A North Carolina Administrative Code 13B .0841(e)(1) because septage was observed on the ground at the truck offloading area.
ADDITIONAL COMMENTS
1. The septage treatment facility consists of one 225-gallon tank and three 5,300-gallon tanks for an approximate total capacity of 16,125 gallons for the storage of treated and untreated septage. Also observed were two dewatering boxes and a final processing box.
2. The area around the storm drain had been cleaned of the waste that was observed on February 11, 2022. However, evidence of recent drainage of what appeared material from plastic storage container into the storm drain was observed (see photo below). Staff at ERT stated that the substance is either a caustic or polymer and not septage. A copy of this report will be forwarded to City of Winston Salem Stormwater and Erosion Control Department for review.
3. A small barrier was observed in front of the roll-off container (see photo below). Staff stated that addition new barriers had been purchased and will be put in place. At the time of inspection, they were observed still in their boxes.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

4. A septage spill was observed at the truck unloading area (see photo below). This spill is a violation of 15A NCAC 13B .0841(e)(1). According to staff the assistance of the next pumper vehicle would be required to clean up the spill. ERT must develop a self-sufficient means for staff to clean up liquid spills.
