OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0405(a)(11) Site Cleaning and Maintenance states in part: "The tipping floor, push walls, and
truck loading bays shall be cleaned with a pressure washer no less than once per month. The remaining areas of
the site building including side walls and any material storage areas outside of the building shall be cleaned with a
pressure washer no less than twice per year. Wash water generated from cleaning waste handling areas shall be
contained and treated as leachate."
Graham County is in violation of 15A NCAC 13B .0405(a)(11) for failure to pressure wash the side walls
and beams of the transfer building with a pressure washer no less than twice per year.
During the March 2, 2022 inspection of the transfer station, the upper portions of the side walls and steel
beams were observed to be soiled with dirt and diesel soot. Mr. Colvard stated that the tops of the walls

were not cleaned due to the lack of equipment to reach the upper areas of the transfer building.
To correct the violation, Graham County must pressure wash the sidewalls and beams of the transfer
building by April 15, 2022 as required in 15A NCAC 13B .0405(a)(11).
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on March 2, 2022.
2. Waste is transported by Graham County to the Haywood County, White Oak Landfill (4407-MSWLF-1993) in
Waynesville, NC.
3. The facility is open to the public Monday through Friday, 7:30 am to 4:00 pm and Saturday, 7:30 am to 3:00
pm.
4. The site is secured by gates and fencing to prevent unauthorized access.
5. Signage was posted at the entrance to the facility stating the name of the operator of the site, emergency contact
information, operating hours, permit number of the current permit authorizing operations, the types of waste
that can be accepted under the permit, and that hazardous waste and liquid waste cannot be accepted.
Records Review
6. The current permit and operations plan were available for review upon request.
7. Waste screening records from March 10, 2021 to February 16, 2022 were reviewed. The forms showed the
final disposition of any unacceptable material that was encountered. Waste screening forms appeared to comply
with the requirements of 15A NCAC 13B .0405(8)(A).

9. Tonnage records were reviewed from the 2020-2021 Facility Annual Report. The facility received 7,129 tons
of waste from July 1, 2020 to June 30, 2021.
Operations Inspection of the Transfer Station (3803-TRANSFER-)
10. Windblown waste was minimal and well managed at the time of inspection.
11. Roads were of all-weather construction and were being maintained to be accessible by loaded collection
vehicles.
12. The facility utilizes fire extinguishers on each side of the tipping floor entrance and a water hose for use in the
event of a fire.
13. The trench drain at the entrance of the tipping floor appeared to be clear and functioning properly.
14. The push walls were in good condition with the exception of an area on the east wall near the loading bay. A
small piece of rebar was exposed where the concrete had been damaged. Continue to monitor the area and make
repairs as necessary.
15. Spalling was observed on the tipping floor and aggregate is now visible. Continue to monitor the floor and if
any rebar becomes exposed, a repair plan will be necessary.

16. The upper portions of the side walls and steel beams were observed to be soiled with dirt and diesel soot. Mr.
Colvard stated that the tops of the walls were not cleaned due to the lack of equipment to reach the upper areas
of the transfer building. Per 15A NCAC 13B .0405(a)(11), side walls and any material storage areas outside
of the building shall be cleaned with a pressure washer no less than twice per year. See Observed
Violations Section of this report.
17. No waste was on the tipping floor and no unapproved waste was observed in the trailer at the time of inspection.
18. Minimal waste was observed on the loading bay floor and the leachate drain appeared to be functioning
properly.
Operations Inspection of the White Goods and Tire Area
19. The facility collects white goods and scrap metal on a concrete pad located to the south of the scale house. The
collected material is sent to Parrish Contracting in Franklin for recycling.
20. White goods containing refrigerants are segregated and refrigerants are evacuated by county staff.
21. Scrap tires are collected and stored in two van trailers adjacent to the white goods area. No tires were stored
outside the trailer at the time of inspection.
Operations Inspection of the Electronics and Cardboard Recycling Area
22. Electronics are collected and stored undercover to the south of the white goods area. Collected electronics are
placed in gaylord boxes and are sent to Synergy Recycling in Madison, NC for processing.
23. The facility collects and bales corrugated cardboard. The baled material is sent to Jackson Paper in Sylva, NC
to be recycled into corrugated fluting.
