Attachment 4, Conditions for Closure, Monitoring and Reporting Requirements, 3. of the Permit for Closure 440 1 -INDUS- 1979 states "Groundwater, surface water, and landfill gas monitoring locations must be established and monitored as identified in the approved plans." International Paper Company is in violation of 15A NCAC 13B .0203(d) for failure to monitor landfill gas in accordance of the approved Landfill Gas Monitoring Plan dated December 10, 2009 (FID 9055). During the February 23, 2022 inspection of the closed landfill, landfill gas monitoring records were reviewed. Page 1 of 6 D_E FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management �aA1��ARo��NA � °`��`°'It °°'ro°m° �� Solid Waste Section During this review, results stated that 4401B-CBP2 was not tested on 11/19/2020 or 5/20/2021, 4401B-CBP3 was not tested on 11/19/2020, 4401B-CBP4 was not tested on 8/19/2021 and 4401B-CBP9 was not tested on 11/19/2020 or 2/15/2021. The results also indicated that monitoring inside structures had not been conducted in the Baseball Storage Shed (LF5B-A2), Football Storage Shed (LF5B-A3) on February 15, 2021. The results stated "Unable to access" in all instances of missed monitoring. To correct this violation, International Paper Company, must immediately provide field notes or sampling results from the fourth quarter 2021 indicating all landfill gas monitoring wells have been sampled as required in the approved Landfill Gas Monitoring Plan dated December 10, 2009 (FID 9055). If all the landfill gas monitoring wells were not sampled during the fourth quarter 2021 monitoring event, then field notes from the first quarter 2022 monitoring event (which must take place prior to March 31, 2022) showing all landfill gas monitoring wells have been sampled must be submitted on or before April 15, 2022. Copies of field notes shall be submitted by email to lee.hill@ncdenr.gov. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on February 23, 2022. 2. The area received approximately .73 inches of precipitation during the 24 hours prior to the inspection. 3. Landfill gas monitoring records from 11/19/2020, 2/15/2021, 5/20/2021 and 8/19/2021 were reviewed and no exceedances were noted. However, results stated that 4401B-CBP2 was not tested on 1 l/19/2020 or 5/20/2021, 4401 B-CBP3 was not tested on 11 / 19/2020, 4401 B-CBP4 was not tested on 8/19/2021 and 4401 B-CBP9 was not tested on 1 l/19/2020 or 2/15/2021. The results also indicated that monitoring inside structures had not been conducted in the Baseball Storage Shed (LF5B-A2), Football Storage Shed (LF5B-A3) on February 15, 2021. The results stated "Unable to access" in all instances of missed monitoring. See Observed Violations section of this report. 4. The top of the cap of Landfill Area 5C is being mowed for hay and side slopes are being maintained by a contractor. 5. A sediment trap from the construction of the livestock market is still installed on the cap of the landfill. The sediment trap is holding water and is no longer needed for erosion control. Remove the sediment trap to prevent excess water infiltration into the cap. 6. A stockpile of soil located on the top of the landfill cap near the livestock center is not being maintained and is growing trees and woody vegetation. This area must be maintained in the same manner as the rest of the cap. Remove the trees and woody vegetation from the stockpile. 7. Approval for improvements to stormwater management infrastructure were approved on May 21, 2020 and the project located on 5C was completed in July 2021. Failing corrugated metal drainage pipe was replaced with HDPE pipe, and two additional HDPE pipes and drop inlets installed to better manage stormwater. Vegetation in some areas of the cap that was disturbed during the stormwater project is sparse and additional seeding should take place to prevent erosion. 8. Ponding water was observed on the landfill cap due to waste mass settlement. Mr. Colquhoun stated settling issues on 5C would be addressed when the stormwater work on 5B starts in March. Repair the cap to prevent ponding water. 9. The International Paper Sports Complex is located on the cap of Landfill Area 5B. This area includes three baseball/softball fields and a walking trail and is maintained by the Town of Canton. 10. The walking trail is located on the southeast side of the landfill cap. A depression with ponding water was observed on the east side of the interior of the walking track. The presence of wetland vegetative species indicates the area has been holding water for a long period of time. A post Tropical Storm Fred inspection conducted by Mr. Colquhoun revealed exposed waste on the southwest side of the cap. Mr. Colquhoun stated staff had immediately covered the area with plastic and installed sandbags to prevent additional cap damage. He added that additional soil will be brought in to repair the area during the 513 stormwater project. 12. Woody vegetation was observed growing on the northern side of the cap in the walking trail area. Remove the woody vegetation from the cap. 13. What appears to be manure and material from barn stall cleaning has been applied to the landfill cap. This material appears to be heavily concentrated in some areas and has been applied in close proximity to stormwater drainage devices. This issue has been referred to the Department of Environmental Quality, Water Resources for further investigation. 14. It also appears that the vehicle used to apply the material left ruts and has damaged the cap. Repair the ruts and damage that was caused by vehicular traffic.
