A. Permit to Operate Part VI (44)(C), "Waste may be stored on -site, in leak proof containers, with watertight
covers, in accordance with the approved documents. Storage of the waste must not cause any nuisance, such
as odor or attraction of vectors." and G.S. 130A 309.05 (c) (1), "Seventy-five percent (75%), by weight or
volume, of the recovered material stored at the facility at the beginning of a calendar year commencing
January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year."
UNRESOLVED: The pile of shingles observed during previous inspections is still located at the facility. The pile
of shingles has been reduced slightly, however, was not reduced by 75% by December 31 as required in G.S. 130A-
309.05 (c)(1). Based on previous correspondence with Mr. Wall's engineer, a permit modification will be completed

to include asphalt shingle recycling. A permit modification must be submitted to Diana Felix at
diana.felixAncdenr.gov.
OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0562 (a), "'Beneficial fill' means a fill activity to level or bring an area to grade for the
beneficial purpose of stabilizing the land or improving the land use potential using only inert debris waste."
And 15A NCAC 13B .0101(28), "'Inert debris waste' means inert debris that consists solely of asphalt, cured
concrete, brick, concrete block, gravel, and rock. Inert debris waste shall not contain chemical adhesives or
sealants, or lead -based paint."
During this inspection, the inert debris pile comingled with unacceptable countertop waste was actively being crushed
and processed. Based on this inspection, the countertop waste had not been removed from the inert debris pile. The
countertop waste had been crushed with the concrete and utilized in the roadway at the site. Quartz and other countertop
wastes do not meet the definition of an inert debris as defined in 15A NCAC 13B .0101 (28), as they have been treated
with sealants or have adhesives on the back. As identified in previous inspection reports, the granite and quartz
countertop wastes are considered to be unacceptable waste and MUST be removed from inert debris pile and
disposed of at a permitted facility. The comingled crushed countertop and concrete that was utilized as a road
base, MUST be removed and disposed of at a permitted facility.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact
information as well as materials accepted at the facility.
2. The area directly to the west of the scale house, had been prepped and leveled for the possible construction of a
transfer station building. A building, for the recycling of metal, had been constructed to the north of the scale house.
A permit modification must be submitted to Diana Felix if there are any changes to the facility or operations.
3. A water truck is located at the property and is used to control dust emissions at the facility. At the time of this
inspection, the water truck was being utilized to reduce dust emissions from the facility.
4. 15A NCAC 13B .0564 (6)(b), "Buffer Requirements: A site shall maintain the following buffer
requirements: 100 feet from the waste boundary to property lines, residential dwellings, commercial or
public buildings, and potable wells." and Permit to Operate Part VI (32), "A buffer of at least 100 feet must
be maintained between the property line and the treatment and processing operation." Chris Gustin with
Carlson Environmental Consultants (CES), stated during a conversation prior to the inspection, that the area had
been flown and surveyed recently. The survey would be used to calculate the air space in the LCID. Previous
communication with CES stated that an updated site drawing with buffer zones would be completed. Please
provide the Section a copy of the updated site drawing, once completed.

5. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary
for access by emergency or fire -fighting vehicles and equipment." and 15A NCAC 13B .0301 (6)(D), "Buffer
Requirements ... surrounded by an unused and cleared area of no less than 25 feet to allow access for fire or
emergency response vehicles." The facility is in the process of installing an access roadway around the LCID;
however, the roadway was constructed with the comingled crushed countertop waste and concrete. Ensure that the

access roads are established and maintained around all areas for fire and emergency response vehicles.
6. The working face of the LCID was less than one acre. The working face had a slope that was steeper than three
horizontal to one vertical. Mr. Jarboe stated that the LCID attendant was in the process of moving and covering the
waste to meet the three horizontal to one vertical slope requirement. Ensure that all waste is covered with a
minimum of 6 inches of soil every 30 days or when the working face reaches one acre, whichever occurs first.
7. Mulch had been applied to the side slopes of the LCID to help prevent erosion and allow vegetation to be
established.

8. Several solar panels were observed within the metal recycling pile located to the east of the tipping floor. Ms.
Thompson told Mr. Jarboe that the solar panels could not be accepted at the facility and that they needed to be
removed from the facility and properly disposed of. Mr. Gustin (CES) provided the Section with photographs of
the solar panel removal, solar panel disposal ticket, and the solar panel waste rejection documentation. Ensure that
solar panels are not accepted at the facility.
9. Windblown was actively being picked up around the MAT area during this inspection. Ensure that windblown is
removed prior to the end of the day.

10. The mulch located in the TP area had been windrowed into smaller piles. During the October 2021 inspection, Mr.
Wall stated that the mulch would be moved to the front of the facility after the pad area had been leveled. The mulch
would be dyed and available for purchase in bulk or in bags. A bagging line would also be installed in the front of
the facility. The area in the front of the facility had been prepared for the public sale of mulch. The bagging line
had not been installed at the time of this inspection.
11. Records were not reviewed during this inspection.
12. These facilities must be operated and maintained in accordance with the current permit and approved
operation plans. Any changes to the operations or modifications of the facility must be submitted to the
Permitting Branch for approval before commencing or making changes.
