Airy), 8602-CDLF- (Mt. Airy), and 8602-CDLF-2011 (Mt. Airy) was issued to Surry County on December 16, 2020. PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: 15A North Carolina Administrative Code 13B .1626(2)(b) states: “Except as provided in Sub-Item (c) of this Item, the owners or operators of all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors.” During the previous inspection, multiple portions of the landfill surrounding the current working face had not been adequately covered at the end of the previous working day leaving waste exposed. An area of most concern was located at the southern extent of the current lift. Mr. Collins explained waste was last placed in this area on January 24, 2022. As a result, Surry County was found in violation of 15A NCAC 13B .1626(2)(b) for failure to cover solid waste with six inches of earthen material at the end of the operating day. To achieve compliance, Surry County was required to cover all waste within the landfill with a minimum of 6-inches of earthen material or approved alternative cover material at the conclusion of the operating day. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 Inspection of the facility on February 16, 2022 found good soil cover on the inactive portions of the landfill. Initially, a portion of the landfill previously covered by a synthetic tarp had exposed waste as a result of a portion of the tarp being displaced leaving waste exposed. Inspection of this area later in the day found the tarp had been removed and the area covered with soil. Therefore, this violation is considered resolved. Thank you for your cooperation in this matter. Moving forward, please ensure all waste is covered as required at the end of the working day. OBSERVED VIOLATIONS: No new violations observed. ADDITIONAL COMMENTS 1. The facility consists of a lined municipal solid waste landfill unit, white goods area, tire collection area, a land clearing and inert debris landfill unit, and a recycling area for the collection of paper, cardboard, glass and plastic containers, aluminum, steel cans, batteries, cooking oil and electronics. 2. The facility is permitted to receive waste generated within a 90-mile radius of Surry County. 3. Scrap metal is collected adjacent to the concrete pad designated for the collection of white goods. 4. A gate was provided at the entrance of the facility to prevent unauthorized access. 5. The facility had proper signage. 6. This was a partial inspection to evaluate Surry County’s efforts to comply with the violation documented on the previous inspection report issued on February 4, 2022. Please refer to “Status of Past Noted Violations” for comments. Operations Inspection of the MSWLF Unit: 7. At the time of the inspection, waste was being placed along the eastern edge of Phase 4 at the transition point from Phases 1 and 2. 8. The working face was very small and compact. 9. Windblown waste was well controlled. 10. Edge-of-waste markers were in place around the perimeter of the landfill. 11. The rain liner was in place over the portions of Phase 4 where waste had not yet been placed. 12. All access roads were of all-weather construction and well maintained. Supporting Comments: 13. During the previous inspection, a wood storage and grinding area was observed just north of Phase 4 of the MSWLF Unit. Mr. Collins stated storage of wood waste had been ongoing for approximately four to five months. He explained that waste had recently been ground for the first time by a private contractor. The site map included with the approved Operations Plan for the facility delineates a “Mulch Storage Area” north of Phase 4 but makes no mention of wood grinding operations at the facility. x Upon discussion with the Permitting Branch, it was requested that Surry County submit a revised Operations Plan to the Solid waste Section detailing the wood grinding operation within 30-days of issuance of the previous inspection report. Details should include, but not be limited to, wastes excepted, storage limits, waste screening practices, and frequency of grinding. x It is understood that Ms. Montgomery has contacted Mr. Gaither in reference to the submittal of a revised Operations Plan. Please continue efforts to submit the revised plan. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
