The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on February 8, 2022.
2. A letter of closure for the Unlined Industrial Process Waste Landfill Unit (8805-INDUS-1974) was issued to
Ecusta Real Estate 2, LLC and P. H. Glatfelter on November 18, 2005.
3. The landfill property is owned by Davidson River Village, LLC and is maintained by P.H. Glatfelter, Inc.
4. North Carolina Brownfields Project, Ecusta Gateway (Project ID 17013-13-88) has been constructed across a
southeastern portion of the landfill. The project consists of three bridges and a roadway across the closed landfill
for access for future development of the Ecusta property.
5. Issues related to the redevelopment project are being referred to the Brownfields program.
Issues Related to the North Carolina Brownfields Proiect, Ecusta Gateway (Proiect ID 17013-13-88)
6. No fencing or access control has been installed at the landfill since the roadway opened. During this inspection,
multiple vehicles were observed stopping and using the landfill as a parking area. The landfill must be
secured to prevent unauthorized access and possible damage to the cap and monitoring network.
7. A stone filter ring, installed as a temporary erosion control measure during the construction of the roadway, has
not been removed. The ring was designed to prevent sediment from entering the culvert. The ring is now
clogged with debris and sediment, and is not functioning as designed. Instead, the stone filter is preventing the
flow of water through the culvert, causing ponding in the landfill ditch line. Remove the stone filter ring to
allow storm water to drain from the landfill.
8. A powerline tower had to be replaced to ensure adequate clearance across the roadway. Mr. Cody stated that
when the tower was replaced, material was staged on a portion of the landfill near the tower. Placing material
on that portion of the landfill caused settling, and as a result, ponding water. Repair the landfill to prevent
ponding of water on the cap.
9. It appears that efforts to stabilize the roadway side slopes with permanent vegetation have been unsuccessful,
leaving the area susceptible to erosion. Monitor the side slopes and reseed as necessary to maintain
groundcover sufficient to restrain erosion.
10. The ditch line on the northwest side of the roadway appears to lack positive drainage, as evidenced by ponding
water and grass species that grow in wet conditions. Repair the drainage ditch to allow water to flow off the
landfill and not into the cap.
11. Construction of the new roadway near the intersection of Highway 64 has blocked the flow of surface water
from the landfill to the water quality pond, located on the northeast corner of the landfill property. Regrade this
area of the landfill to ensure that storm water is directed off the landfill cap and to prevent ponding.
12. Silt fence with stone outlets had been installed as a temporary erosion control measure on the eastern side of the
roadway project during roadway construction. Although most of the silt fencing has been removed, the stone
outlets remain. Remove the stone outlets and reseed this area to ensure adequate vegetative cover.
13. Saplings and woody vegetation have begun growing on the portion of the cap that was inside the disturbed area
of the roadway project on the northeast side of the landfill. Remove the saplings and woody vegetation and
make any necessary repairs to restore the integrity of the cap.
14. Wattles were observed in the drainage channel southeast of the roadway, causing water to pond instead of
draining to the water quality basin as designed. Remove the wattles from the ditch line to ensure that water
flows to the pond as designed.
Other Landfill Comments
15. The drainage ditch on the northwest side of the landfill was holding water and appears not to have enough fall
to allow the water to drain as designed. Repair the drainage ditch to ensure that water can leave the
landfill as designed.
16. Multiple depressions were observed on the landfill cap. Fill, repair and reseed all depressions to prevent
ponding of water on the cap.
17. Permanent edge of waste (EOW) markers constructed of a metal sign and stake are installed around the outside
perimeter of the landfill and were visible at the time of inspection.
18. All groundwater monitoring wells were observed to be locked and in good condition at the time of inspection.
