PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 15A NCAC 13B .0405 OPERATIONAL REQUIREMENTS: (10) & (11) – (areas highlighted in red) The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS: 01 - This facility was issued a Life of Site permit on April7, 2021 and expires on December 23, 2057. 02 - The Permit to Operation and Operations Plan were reviewed during this inspection. 03 - This inspection was conducted due to non-compliance issues that were self-reported by Michael Lee – GFL Operation Manager on Tuesday, February 15th, 2022, & Friday, February 18th, 2022 by emails. 04 - Waste was being left on the tipping floor for several days. 05 - During this inspection, several Observed Violations were noted below. (highlighted in red). 06 - 15A NCAC 13B .0405 OPERATIONAL REQUIREMENTS: * (10) Windblown waste: Site staff shall conduct daily inspections for windblown waste on the site property. Windblown litter from site operations discovered during the daily inspections or observed on adjacent properties shall be picked up and containerized for disposal by the end of each operating day, unless the landowner of the adjacent property denies access to site staff. The site shall prevent waste from being blown outside the waste handling areas by the wind, using methods such as: (A) requiring that vehicles entering and leaving the site keep waste covered; (B) providing skirts, such as rubber belting or brushes, around the top of chutes to minimize the space between the chute and the hauling trailer at sites with chutes and hoppers; or (C) preventing waste from leaving the site using methods such as fencing, netting, or diking. * (11) Site Cleaning and Maintenance: Unless otherwise stated in the site permit, all waste shall be removed from the tipping floor, the truck loading bays, and from behind push walls by the end of each day of operation and disposed of in accordance with this Subchapter. The tipping floor, push walls, and truck loading bays shall be cleaned with a pressure washer no less than once per month. The remaining areas of the site building including side walls and any material storage areas outside of the building shall be cleaned with a pressure washer no less than twice per year. Wash water generated from cleaning waste handling areas shall be contained and treated as leachate. Cleaning and maintenance records shall be maintained and made available to the Division upon written request. 07 - This facility is contracted to Stella Environmental Service for daily operations and hauling. 08 - Michael Lee contacted Stella Environmental Services, Division Manager, Sinclair D. Nedd during this inspection to get more haulers to this facility to get into compliance. 09 - Michael Lee also contacted GFL transportation for assistance with haulers in this matter. 10 - Michael Lee contacted the contract lawn maintenance crew to come and help address the Windblown trash issue. 11 - John College left the site for 2 hours or so and returned at 01:30 pm. To check on any progress made towards compliance. 12 - Upon John College’s return, Stella Environmental Services, Division Manager, Sinclair D. Nedd was on-site along with Michael Lee, and they made the decision to shut down the transfer station to be able to remove all the waste and clean the facility. 13 - Pictures were sent to John College of the clean tipping floor on Tuesday, February 22, 2022. 14 - John College had taken pictures during the site inspection. 15 - Attached to this report are before and after pictures of the tipping floor and other pictures are attached as well. 16 - Follow-up inspections are to be conducted to ensure compliance is being met.
