The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The purpose of this visit was to conduct a Comprehensive Inspection of the Yard Waste Notification (YWN).
Several attempts to contact the Town of Spring Lake were made before arriving onsite. A renewal has not been submitted since 2018. Mr. Powell would like to thank onsite staff for their assistance with this inspection.
2. Upon arriving and speaking with onsite staff, Mr. David Vandergriff and Mike Eckert were contacted and arrived shortly after onsite. Mr. Powell was shown the site, which is behind a public works building near back of property. The site is behind the fence, surrounding that building, and over a sanitary sewer easement. A
manhole is in the center of the small open area behind the building. There was no waste visible onsite.
3. Mr. Powell discussed the site with both Mr. Eckert and Mr. Vandergriff. They explained it was only used during storm events and all of the towns yard waste goes directly to Wilkes road facility generally. If storm waste was needing to be stored at this site, it would only be temporarily here and then removed to Wilkes road soon after.
After speaking with onsite staff, Mr. Powell measured, using a measure wheel, the width (120 feet) and depth (90 feet) of the open area from fence to manhole. There was a ditch/swale on each side of this open area. Basically once buffers are considered there isn’t hardly any area left to be used for the notification. Also, Mr. Powell
reviewed GIS data from Cumberland County GIS mapping system later and enabled the wetlands layer to find wetland on or every close by edge of the open area being used as a notification.

4. The Section will consider Spring Lake’s YWN-26-002 CLOSED. It can no longer be used to store yard waste, including storm debris, and to do so may be considered illegal dumping and be in violation of Solid Waste Rules.
5. If the Town wishes to have a Yard Waste Notification, then a more suited piece of property should be considered that can meet rule requirements. YWN’s are for storage/composting/processing of yard waste and are considered to be Small Type 1 facilities in Solid Waste Rules. They are limited to 2 acres and 6,000 cubic
yards of waste, including finished product, at any given time. The YWN rules are 15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications).
In addition, if the needs are only for storm related debris storage/processing, then a Temporary Disaster Debris
Site (TDDS) should be considered. TDDS rules are 15A NCAC 13B .0208 and a pdf copy of each will be sent as an attachment with this inspection report link. A link to the Sections website for guidance on both the Yard Waste Notifications and the TDDS sites will also be provided in the email. Once the Town determines what they need, if anything, they can follow the guidance on those links provided and Mr. Powell can assist if needed.
