Dear Mr. Sides:
On February 10, 2022, Troy Harrison Environmental Specialist II, representing the State of North
Carolina, Division of Waste Management Solid Waste Section (Section), inspected the above
referenced facility for compliance with North Carolina solid waste statutes and rules. Mr. Alex
Stone was present and represented Environmental Relief Technology, Inc. during this inspection.
The following violations were noted:
A. 15A North Carolina Administrative Code (NCAC) 13B .0838(e)(1) states: “Each detention and
treatment facility shall be designed, constructed, and maintained in such a manner as to
prevent leaks or the flow of septage out of the facility into the seasonally high water table,
onto the ground surface, or into any surface waters.”
Environmental Relief Technology, Inc. was in violation of 15A North Carolina Administrative
Code 13B .0838(e)(1) because leachate was allowed to flow into a storm drain.
B. 15A NCAC 13B .0837 (m) states in part: “Applications for renewal permits shall be submitted
to the Division at least 90 days prior to the expiration of the permit.”

Environmental Relief Technology, Inc. was in violation of 15A North Carolina Administrative
Code 13B .0837(m) because permit number SDTF-34-02 issued to Environmental Relief
Technology, Inc. will expire on March 1, 2022 and an application for renewal has not been
received.
Based upon the foregoing, Environmental Relief Technology, Inc. shall come into compliance by
March 1, 2022 with all requirements of the regulations in 15A NCAC 13B .0838(e)(1) and 15A
NCAC 13B .0837(m) by completing the following:
1. Immediately cease all illegal discharges of liquid resulting from the de-watering process
of septage grease.
2. On August 14, 2018 a revised “Permitting and Operations Manual” was submitted by
Environmental Relief Technology, Inc. in response to a Notice of Violation issued on
August 8, 2018. By March 1, 2022, submit the results of your investigation into the spill
and what occurred to cause the release of septage into the storm drain and what will be
done in the future to prevent spills of septage at 617 Waughtown Street Bldg. Send the

3. Immediately submit an application for renewal to:

The violations listed above were observed by Section staff and require action on behalf of the
facility in order to come into or maintain compliance with the Statutes, Rules, and/or other
regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22,
an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid

Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the
N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management
facility or a solid waste collection service and any such further relief as may be necessary to
achieve compliance with the North Carolina Solid Waste Management Act and Rules.
Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct
a follow-up inspection(s) to verify that the facility has completed the requirements of this Notice
of Violation.
