STATUS OF PERMIT: Active Issued: 9/22/2017 Expires: 3/1/2022* *A request for renewal has not been received PURPOSE OF SITE VISIT: Permitting Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 1. 15A North Carolina Administrative Code (NCAC) 13B .0841(e)(1) states: “Each detention and treatment facility shall be designed, constructed, and maintained in such a manner as to prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters.” Environmental Relief Technology, Inc. was in violation of 15A North Carolina Administrative Code 13B .0841(e)(1) because leachate was allowed to flow uncontrolled into a storm drain. 2. 15A NCAC 13B .0837 (m) states in part: “Applications for renewal permits shall be submitted to the Division at FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 least 90 days prior to the expiration of the permit.” Environmental Relief Technology, Inc. was in violation of 15A North Carolina Administrative Code 13B .0837(m) because permit number SDTF-34-02 issued to Environmental Relief Technology, Inc. will expire on March 1, 2022 and an application for renewal has not been received. ADDITIONAL COMMENTS 1. The septage treatment facility consists of one 225-gallon tank and three 5,300-gallon tanks for an approximate total capacity of 16,125 gallons for the storage of treated and untreated septage. Also observed were two dewatering boxes and a final processing box. 2. The storage or treatment of any other liquid or solid waste other than grease septage is prohibited. 3. Wastewater from this facility is permitted to be discharged to the Archie Elledge WWTP. Solids from the treatment process are permitted to be disposed at the Haynes Mill Road Landfill (Solid Waste Permit 34-02), Winston-Salem, Forsyth County, NC. Solid waste material is also disposed at the Wallace Farms composting facility. 4. “No Trespassing” sign was posted on the exterior of the building at the time of inspection. 5. No objectionable odors were observed outside of the facility. 6. Evidence of drainage from a de-watering box into a nearby storm drain was observed (see photo below). The existence of accumulated waste on the storm drain grate indicate that the flow of waste is a regular occurrence. 7. Waste was observed accumulated around a roll-off container needs to be cleaned up (see photo below). This was also observed during the previous inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Solid Waste Management Permit SDTF-34-02 was issued on September 22, 2017 and expires on March 1, 2022. NCAC 13B 0837(m) requires that an application for renewal be submitted at least 90 days prior to permit expiration. An “SDTF Renewal Notification” dated November 4, 2021 was sent to Environmental Relief Technology, Inc (ERT). You will not be able to operate legally if an application for renewal is not received by the expiration date. 9. It is the understanding that ERT is planning to relocate to a different location. Septage permits are not transferrable to a new location. In order to facilitate an orderly transition a new application must be submitted as soon as it is possible. A copy of the SDTF permit application is included with this report. In addition, a local government zoning consistency letter must be submitted for the new location.
