Subject: Response to Notice of Violation
Yancey -Mitchell Transfer Station
Yancey County, North Carolina
Dear Messrs. Hetzell and Coffey:
The North Carolina Department of Environment and Natural Resources (DENR) Division of Waste
Management Solid Waste Section issued a Notice of Violation (NOV) to Yancey County and Mitchell
County on March 8, 2007 with respect to the Transfer Station operations (Permit Number 100-03T). This
letter, prepared by Altamont Environmental, Inc. (Altamont) on behalf of Yancey County and Mitchell
County, explains the corrective actions enacted in order to address the NOV.
BACKGROUND
Two separate piles of Landclearing and Inert Debris (LCID) and stockpiled waste (trash and pallets) were
stored adjacent to the Transfer Station.
The March 8, 2007 NOV states:
"To correct this violation and be in compliance with 15A North Carolina
Administrative Code 13B .0201(a), within 20 days from receipt of this
Notice, remove the LCID waste and stockpiled waste (trash & pallets) to
facilities permitted to receive those wastes. Provide records of waste
tonnage removed from the site."
CORRECTIVE ACTION
Yancey County utilized Riverside Stump Dump Inc. (Riverside) from Asheville, North Carolina to grind
the LCID waste and stockpiled waste and remove them from the site. Riverside holds a Permit Number
1141 to operate a Solid Waste Management Treatment and Processing Facility issued by the DENR. The
Riverside permit is enclosed for your reference.
Weigh tickets from the corrective action show that 1,631,220 pounds (815.61 tons) were removed from
the facility. The weigh ticket tabulation is enclosed for your reference.

Dear Ms. Lawhern:
Enclosed is a Modification to the Permit to Operate for the referenced Solid Waste Transfer
Facility for Yancey and Mitchell Counties and the accompanying conditions for the above
referenced facility.
As requested by the County, the modification reflects a change in operator to Republic Services
of NC, LLC., and a change in the approved disposal site to Foothills Regional Landfill in
Caldwell County.
