Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Section staff met onsite to conduct a follow up inspection on the yard waste notification. YW has all been removed, site cleaned up, and looks good. Documentation/photos were provided for the YW removal on 1/22/2021, and clean concrete has been gathered for recycling at another site. Relevant rule for clean concrete, “130A-309.05. Regulated wastes; certain exclusions,” sent before to Mr. Sutherland. Concrete removal documentation will be sent later on by Mr. Sutherland via email. Small amount of asphalt is still in the back that City will use as needed to repair asphalt in the streets. Good job. Looking toward entrance. Soil is stored here in two piles. It was the intention for the City to close this YWN facility, but upon review, Mr. Sutherland has decided it may be a benefit in the future to keep the YWN open. This will provide a place for YW to be staged and processed if needed. Discussion onsite were also about making this area a TDDS (Temporary Disaster Debris site) if possible. Mr. Powell forwarded information from Section s website for Mr. Sutherland to start the process if the City chooses and he believes the site will meet 13B .0208 (b)(1-12). Once initial information is received, a follow up inspection will need to be done to confirm the site meet the rules outlined in .0208. 3. It was requested by Mr. Powell that the 2-acre notification have EOW (edge of Waste) markers installed so that the buffers could be better checked if the site was used in the future. They should be on the corners and enough of them to be visible from one to the other. This will help onsite staff keep waste inside the approved areas during its operation. Suggest tall, white PVC pipe. Photos can be sent to Mr. Powell with concrete removal documentation. The YWN should remain clear from anything being stored on it and renewal submitted every year on time if going to be used as well. 4. Remember, a Yard Waste Notification (YWN) is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year.
