NOTICE OF VIOLATION(S) (citation and explanation):
1. 15A NCAC 13B .0531(c) requires: "Owners and operators of C&DLF facilities and units must conform to
the requirements of Rules .0531 through .0547 of this Section as follows: C&DLF units permitted to
operate prior to January 1, 2007, and which do not receive solid waste after June 30, 2008, must comply
with the Conditions of the Solid Waste Permit and Rule .0510 of this Section.
15A NCAC 13B .0510 requires that a disposal site be closed in accordance with rule .0505 of this
Subchapter.
15A NCAC 13B .0505(1) requires that any person who maintains or operates a sanitary landfill site
shall maintain and operate the site in conformance with their plan and permit requirements.

General PermitConditi n Number of the Permit defines the Approved Plan as being described by
Attachm26til;;"List ocuments for the Approved Plan". Included in the "List of Documents for the
Approved'Plan" is the "Application for Permit To Construct a Solid Waste Management Facility for
Yancey and Mitchell Counties" submitted by Camp Dresser and McKee"; dated December 23, 1993.
Section 5.2.1 of this Application addresses the requirements for the "Monitoring and Maintenance
Activities" elements of the 'Post Closure Plan".
Yancey County and Mitchell County are in violation of 15A NCAC 13B .0531(c) and .0505(1) by failing
to operate the Yancey -Mitchell Construction and Demolition (C&D) landfill in conformance with the
following plan and permit requirements:
(a) Element (A) of the "Monitoring and Maintenance Activities" requirements in the "Post
Closure Plan", which states:
"Maintain the integrity and effectiveness of the cap system, including but not limited to making
repairs to the cover as necessary to correct defects of settlement, subsidence, erosion, or other
events, and prevent run-on an run-off from eroding or otherwise degrading the cap."
The vegetative cover (lespedeza) on the majority of the landfill was three to four feet high. This
obscured most of the "edge of waste" markers which are three feet high and are either 1-inch
diameter PVC pipe, or a metal fence post. The dense vegetative cover made the inspection of
the condition and the integrity of the landfill cap impractical. (See photos #2, #5, and #6.)
To correct this violation and be in compliance with 15A NCAC 13B .0505(a) within 30 days
from receipt of this Notice, Yancey County and Mitchell County must mow the Yancey -
Mitchell C&D Landfill in accordance with the Solid Waste Management Rules, 15A NCAC
1313, Article 9 of the Chapter 130A of the North Carolina General Statutes (NCGS 130A-
290, et seq.), the conditions contained in this permit; and the approved plan.
(b) Element (A) of the "Monitoring and Maintenance Activities" requirements in the "Post
Closure Plan", which states:
"Maintain the integrity and effectiveness of the cap system, including but not limited to making
repairs to the cover as necessaryto correct defects of settlement, subsidence, erosion, or other
events, and prevent run-on an run-off from eroding or otherwise degrading the cap."
The east section of the landfill is covered with multiple trees and other woody vegetation. The
root systems of these trees and woody vegetation compromise the integrity of the landfill cap
which in turn can accelerate both surface erosion and the infiltration of water into the landfill.

To correct this violation and be in compliance with 15A NCAC 13B .0505(a) within 30 days
from receipt of this Notice, Yancey County and Mitchell County must ensure that all trees
and woody vegetation are removed or otherwise cleared from the landfill in accordance
with the Solid Waste Management Rules, 15A NCAC 1313, Article 9 of the Chapter 130A of
the North Carolina General Statutes (NCGS 130A-290, et seq.), the conditions contained in
this permit; and the approved plan.
(c) Element (A) of the "Monitoring and Maintenance Activities" requirements in the "Post
Closure Plan", which states:
"Maintain the integrity and effectiveness of the cap system, including but not limited to making

maintain adequate erosion control measures to prevent excessive on -site erosion.

You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be
assessed for each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be
subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid

AREAS OF CONCERN AND COMMENTS-
1. The access road was maintained in good condition.
2. The facility last received waste on 6/30/08.
3. A well established cover of lespedeza has been established on the landfill. At the time of the audit
this cover ranged from several inches to more than four feet in height.
4. The waste boundary of the C&D landfill has been delineated with permanent markers. The markers
appeared to be about three -feet high and made of either 1-inch PVC pipe or metal fence posts and
identified with the letters "E.O.W." (Edge of Waste). (See photos #5 through #8)

5. As the "E.O.W." markers are approximately three teet high and the lespedeza cover 1s upwards of
four feet high on much of the landfill, it is difficult find all of the E.O.W. markers to discern the limits of
waste / waste boundary. The cover vegetation on the landfill cap is in need of mowing so that
all of the E.O.W. markers can be located.
6. The cover vegetation is dense and overgrown as to preclude completion of an effective inspection of
the landfill cap. The cover vegetation on the landfill cap is in need of mowing
7. There are a number of small trees mixed in with woody vegetation on the east side of the landfill that
need to be removed. (See photo # 9)
8. The water quality monitoring network for the C&D landfill consists of two compliance monitoring wells
(MW-H and MW-I), one background monitoring well (MW-J), and two surface water sampling
locations (SW-1 and SW-2) that are located at the North Toe River.
9. Groundwater samples were collected on March 10, 2010 and surface water samples were collected on
March 11, 2010. All samples were collected by Altamont Environmental and analyzed by Pace
Analytical Services for Appendix I VOCs, Appendix I metals, and additional water quality parameters
(alkalinity, chloride, sulfate, and total dissolved solids). No VOCs were detected at concentrations
exceeding the associated 2L Standards. One VOC (trichlorofluoromethane) was detected in the
groundwater sample from MW-1 at a concentration (1.7 pg/L) above its SWSL. Historically, this
compound has been detected in the other compliance monitoring well, MW-H, at similarly low
concentrations. Three metals, manganese, iron, and chromium, were detected at concentrations
exceeding their respective 2L Standards.
10. As the landfill stopped receiving waste on June 30, 2008, it was closed in accordance with the
conditions of their permit and 15A NCAC 13B .0510
11. 15A NCAC 13B .0503(2)(a) states:
"A site shall meet the following design requirements:
(a) The concentration of explosive gases generated by the site shall not exceed:
(i) twenty five percent of the limit for the gases in site structures (excluding gas control or
recovery system components); and
(ii) the lower explosive limit for the gases at the property boundary."
Please provide documentation showing that the above referenced design requirements have been met. If
no documentation exists, an investigation must be done to determine to determine compliance with 15A
NCAC 13B .0503(2)(a). A preliminary study should be conducted to determine if the landfill is generating
explosive gas within 60 days of receipt of this report. A written summary of the preliminary study must be
submitted to Mr. Wagner at the address previously note in this audit report. Further action maybe required
upon receiving results of the study.

Subject: Response to Notice of Violation in Facility Compliance Audit Report
Yancey -Mitchell C&D Landfill

Dear Mr. Wagner,
On behalf of the North Carolina Department of Environment and Natural Resources (DENR) Division
of Waste Management Solid Waste Section you issued a Facility Compliance Audit Report outlining
several Notice of Violation (NOV) items to Yancey County and Mitchell County on November 2, 2010
with respect to the closed Construction & Demolition Debris (C&D) landfill (Permit Number 100-02).
This letter, prepared by Altamont Environmental, Inc. (Altamont), on behalf of Yancey County and
Mitchell County, explains the corrective actions proposed or enacted in order to address the items
in the Facility Compliance Audit Report.
CITED ITEMS
Item Number 1
Your facility compliance audit report dated November 2, 2010 (report) stated that owners and
operators must comply with their solid waste plan and permit requirements as well as specific solid
waste section rules applicable to C&D Landfill facilities which were permitted to operate prior to
January 1, 2007 and which did not receive waste after June 30, 2008.
The first item you cited in your report included three elements. Each of those three elements
referenced the following language.
Maintain the integrity and effectiveness of the cap system, including but not limited to making
repairs to the cover as necessary to correct defects of settlement, subsidence, erosion, or other
events, and prevent run-on and run-off from eroding or otherwise degrading the cap"
The three elements and their corrections, as you stated in your report, are summarized as follows:

In your report you stated that the facility was in violation of 15A NCAC 13B .0505(4)(b) "...by failing
to maintain adequate erosion control measures to prevent excessive on -site erosion." The
"violation" and its corrections, as you cited in your report, are as follows:
"Two areas of surface erosion (rills/gullies) were observed in the cap of the landfill.. "
"To correct these violations... must fill-in, repair and re -seed all erosion rills and gullies in the cap of
the landfill- and a# waste must be covered with at least two feet of suitable compacted soil... "
RESPONSE
I(a): Mowing of Landfill Cover
The correction in the DENR report requested that the landfill be mowed in order to prevent the
edge of waste markers from being obscured.
The establishment and maintenance of dense vegetation at the landfill is paramount to the integrity
of the landfill cover. Dense vegetation provides the single most effective erosion control measure
at the landfill. Yancey County has provided, in a timely fashion, a thick vegetative cover over the
closed landfill cell.
The seeding schedule associated with the landfill closure was permitted through the DENR Land
Quality Section (LQS). The use of Sericea lespedeza is recommended and was approved by the LQS
for use in the closure of the landfill. Furthermore, the North Carolina Erosion and 5edimentControl
Planning and Design Manual states that "sericea does not tolerate frequent mowing."
Improper timing of mowing for any grass species will reduce the effectiveness of that vegetative
cover. If a grass is mowed during its vulnerable flower bud stage, then that grass species can be
effectively reduced. Sericea lespedeza flowers from late July through October (e.g. the time period
of your compliance audit).
Root mass and grass height are also directly related. It is important in the first few years of grass
growth to let the root mass establish fully. As a result grass height has purposely been kept high
for these first few critical years.
Furthermore, you indicated that in addition to reducing the visibility of the edge of waste markers,
the landfill was difficult to traverse and observe. Altamont has observed this slope prior to and
after your compliance audit, and was able to traverse the landfill without incident. The attached
figure shows the edge of waste marker locations in black.

1(b): Removal of Woody Vegetation
You requested that all trees and woody vegetation be removed or otherwise cleared from the
landfill. Yancey County commenced removing the woody vegetation on November 10, 2010. A
follow-up letter will document the completion of this task.
1(c): Erosion Rills
You did not suggest a correction for this item.
2: Erosion Rills
Your correction requires that the Counties fill in, repair and re -seed all erosion rills and gullies in the
cap of the landfill. Yancey County has repaired the uppermost erosion gulley since receiving your
report. However, Yancey County will have to subcontract to a private contractor the work
necessary to repair the lower erosion gulley. Therefore, a cost has been obtained from a
subcontractor with the appropriate heavy machinery to make the requested repair. This work will
begin as soon as possible. A follow-up letter will notify you of the completion of this task.
LANDFILL CLOSURE STATUS AND LANDFILL GAS EVALUATION
You stated that the landfill "was dosed in accordance with the conditions of their permit and 1511
NCAC 13B.0510." Yancey County informed the DENR of this closure in a letter dated May 29,
2009. Your report is the first known acknowledgment from the DENR of the closure status of the
landfill. Currently, the site is listed as "inactive" or "open" and not "closed." Please list the facility
as "closed" in the DENR Solid Waste Section database.
Landfill gas evaluations have been conducted at the site on multiple occasions. The
instrumentation for collecting the landfill gas samples have been consistent with approved methods
by the Solid Waste Section. These evaluations have not demonstrated exceedances of 100% of the
lower explosive limit (LEL) at the property boundary or 25% LEL within structures. Copies of the
most recent landfill gas evaluation are attached to this letter and are available for review with Ms.
Teresa Summerlin at the landfill scale house.
