Inactive as of July 30, 2008. (Expired June 17, 2002)
PURPOSE OF AUDIT:
Comprehensive audit.
NOTICE OF VIOLATION(S) (citation and explanation):
1. 15A NCAC 13B .0543(c)(5) requires that The owner and operator must begin closure activities for that portion of each C&DLF
unit meeting no later than 30 days after the known final receipt of wastes.
To correct this violation and be in compliance with 15A NCAC 13B. 0543(c)(5) within 7 days from receipt of this Notice,
Yancey and Mitchell Counties must begin closure of the C&D landfill.
Yancey and Mitchell Counties are in violation of 15A NCAC 13B .0543(c)(5) by failing to begin closure activities of
the C&DLF within 30 days of 6/30/08 (the last day the landfill accepted any waste).
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be
assessed for each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be
subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a
solid waste collection service and any such further relief as may be necessary to achieve compliance with the North
Carolina Solid Waste Management Act and Rules.
STATUS OF PAST NOTED VIOLATIONS (List all noted last audit):
1. Violation of 15A NCAC 13B .0505(5)(c) which requires that "completed areas be adequately sloped to allow surface
runoff in a controlled manner." This violation has been corrected.

2. Violation of 15A NCAC 13B .0542(g)(1) which requires that "C&DLF units must restrict solid waste into the smallest
area feasible." As the landfill is no longer accepting waste, this violation has been corrected.
3. Violation of 15A NCAC 13B .0542(g)(2) which requires that "solid waste must be compacted as densely as practical into
cells." As the landfill is no longer accepting waste, this violation has been corrected.
AREAS OF CONCERN AND COMMENTS:
C&D LANDFILL:
1. The service area for this C&D facility is limited to Yancey and Mitchell Counties.
2. The access road was maintained in good condition.
3. Permit signage at the facility entrance is in accordance with the permit.
4. The facility last received waste on 6/30/08.
5. The waste boundary of the C&D landfill should be delineated with permanent markers.
6. Per 15A NCAC 13B .0543(2)(A) "post settlement surface slopes must be a minimum of five percent and a maximum of
25 percent."
7. The slopes of last used cells of the C&D landfill need adequate erosion control measures consisting of vegetative cover,
materials, structures or other devices to prevent sediment from leaving the facility.
8. The slopes of preciously closed cells of the C&D landfill have a good vegetative cover.
9. Dust control measures appear to be adequate.

AREAS OF CONCERN AND COMMENTS:
1. Sporadic, localized rainfall, at times very heavy, occurred over the previous day and during the audit.
2. The access road was paved and well maintained.
3. There was standing water in the receiving bay that was flowing
4. In accordance with the requirements of the Land Quality Section of Division of Land Resources, all final
graded slopes must be stabilized with a vegetative ground cover within 21 calendar days of this inspection.
5. No ground cover has been established. Hydro -seeding and erosion control matting will be initiated
immediately on the final slopes of the landfill. (See Photo # I below.)
6. Erosion control devices have been implemented: perimeter storm water diversion ditches with rip -rap;
storm water ponds; and sediment basins.
7. Dust control measures appear to be adequate.
8. The limits of the C&D landfill must be delineated with permanent markers.
9. The property lines of the C&D landfill must be delineated with permanent markers.
