Ross Jr., Secretary SOLID WASTE SECTION December 30, 2008 Mr. Nathan Bennett Yancey County — County Manager 110 Town Square, Room 11 Burnsville, North Carolina 28714 Subject: Construction & Demolition Debris Unit Closure Yancey/Mitchell Landfill Yancey County, Permit #100-02, Document ID No. 6314 Mr. Bennett This letter is being written to remind you of the regulatory requirements for closure of existing C&DLF units which stopped receiving waste as of June 30, 2008. You notified the Section of your intent to close by letter on June 30, 2008 (Document ID No. 5090). Therefore, the facility should have been closed in accordance with 15A NCAC 13B.0505. These rules specifically require the area to be stabilized with native grasses within six months after final termination of disposal operations. If closure of the facility is not complete, or the area has not been stabilized with native grasses, you will need to submit a written request for an extension. Included in this request must be a revised schedule of all closure activities yet to be completed. If required, please submit the extension request and revised schedule of closure activities no later than January 31, 2009. In addition, at the end of closure activities, the requirements of 15A NCAC 13B.0510(a) must be met. These requirements state you must notify the Division in writing that the disposal site has been closed in accordance with the Rule .0505. A site inspection by the Section is also a requirement. During this inspection you must provide test holes for the Section representative to determine compliance of the final cover. Once closure is complete, please notify and arrange the site inspection with Bill Wagner in the Field Operations Branch.
