Subject: Response to Notice of Violation
Yancey -Mitchell Counties C&D Landfill
Yancey County, North Carolina
Dear Messrs. Hetzell and Coffey:
The North Carolina Department of Environment and Natural Resources (DENR) Division of Waste
Management Solid Waste Section issued a Notice of Violation (NOV) to Yancey County and Mitchell
County on March 8, 2007 with respect to the Construction and Demolition (C&D) Landfill operations
(Permit Number 100-02). This letter, prepared by Altamont Environmental, Inc. (Altamont) on behalf of
Yancey County and Mitchell County, explains the need for a land disturbance permit as well as requests
additional time allotted in the NOV in order to obtain the required land disturbance permit to address the
NOV.
Excessive erosion has occurred on two slopes adjacent to the active C&D landfill. The surface area of the
eroded slopes that need repair is approximately 3.6 acres. Because land disturbing activities associated
with the NOV will exceed one acre, a permit is required from the DENR Land Quality Section (LQS).
The review period for such permit applications to the LQS is typically 30 days. Altamont has a meeting
scheduled with the LQS on Thursday May 3, 2007 to discuss the proposed corrective actions and expects
to submit the permit application to the LQS the following day.
The NOV states, "Repairs should be completed by May 15, 2007." Altamont, on behalf of Yancey and
Mitchell Counties, would like to request an extension from the May 15, 2007 deadline to June 22, 2007 in
order to allow sufficient time to receive a permit from the LQS and perform the corrective actions.

Dear Mr. Coffey
The North Carolina Department of Environment and Natural Resources (DENR) Division of Waste
Management Solid Waste Section issued a Notice of Violation (NOV) to Yancey County and Mitchell
County on March 8, 2007 with respect to the Yancey and Mitchell Counties C&D Landfill (Permit
Number: 100-02). This letter, prepared by Altamont Environmental, Inc. (Altamont) on behalf of Yancey
County and Mitchell County, explains the corrective actions enacted in order to address the NOV.
BACKGROUND
The NOV specified that two damaged slopes down gradient from the active C&D cell did not contain
adequate erosion control measures.
Specifically, the March 8, 2007 NOV states:
"To correct the above Violations and be in compliance with 15A North
Carolina Administrative Code 13B Yancey and Mitchell Counties should
re -grade the side and back slopes to provide berms and stepdowns at
appropriate locations to prevent the rapid runoff of surface waters.
Vegetation should be re-established to prevent further erosion from
starting."
CORRECTIVE ACTION
The total acreage disturbed for the corrective actions was approximately five acres. Therefore, an
approved erosion and sedimentation control plan was obtained from the North Carolina Department of
Natural Resources Land Quality Section before beginning work.
Yancey County utilized Ledford Brothers, Inc. from Burnsville, North Carolina to regrade the slopes,
create slope breaks, and install erosion and sedimentation control measures in accordance with the
approved erosion and sedimentation control plan. The disturbed area was amended with lime and

fertilizer at rates consistent with soil testing and recommendations from the North Carolina Department of
Agriculture and Consumer Services. The disturbed area was seeded and covered with slope matting.
Before and after photographs are enclosed for your reference.
