Dear Mr. Robinson:
It was a pleasure meeting you during my recent visit to the Asheville Regional area. I greatly
appreciated your willingness to entertain the suggestions offered regarding the future
development of the Yancey/Mitchell C&D Landfill. I wish to assure you that the Solid Waste
Section (the Section) will do everything within our power to assist you in the permitting of this
facility. Furthermore, I wish to inform you that I am now in possession of the revised
construction plan for the proposed disposal area submitted to this office by Mr. Vann Waters of
McGill Associates, P.A. It appears to reflect the necessary buffer limits specified during my visit,
and I will be performing a more thorough technical review of this plan within the next week. If
further complications are identified, I will let you know immediately in order to eliminate all
unnecessary delays in the permitting of this facility.
Again, I would like to thank you for your timely submittal of the requested information. If you
have any questions concerning the status of your application, please do not hesitate to contact Mr.

Phased C&D Plan with Monitoring Wells
Dear Mr. Green:
Please find enclosed a revised print of the Phased Site Plan for the above referenced project.
This is identical to the previous plan, except that the location of the monitoring wells have been shown
on the new plan. Please note that well MW-F was not installed per the letter from Jim Bateson, Solid
Waste Hydrogeologist, dated December 5, 1996. The reason for not installing this well was the
discovery that the existing landfill boundaries extended further that shown on the original plans. This
also lead to the relocation of the new C&D landfill buffer area as shown on the enclosed plan.
All of the C&D site work and the well locations are the same as the original approved plans for
the wells and the landfill. The earth berm at the 200' buffer as shown on the plan and constructed in the
field is merely a construction technique to insure that as C&D material is placed, it does not cross into
the buffer.
Please call our office at any time if there are any questions on the plan or additional information
is required. The Counties are anxious to begin removing the stockpiled debris as soon as approval is
given.

C&D Landfill Plan
Dear Mr. Green:
After our phone conversation yesterday, I found a set of CDM original drawings of the
approved C&D landfill plans. Please find enclosed a set of prints on the C&D landfill plans for your
use. As you will see in reviewing this set of plans, the work we are preparing to do on our own plan is
just a phased implementation of the original plan and stays within the horizontal and vertical limits of
the approved plan. Please review the original and our revised operational plan and contact our office if
there are any other questions. The Counties are anxious to begin moving the accumulated C&D
material into the new landfill.
Since you were not aware of an approved C&D plan, during your review of the plans please
consider if the requested 200' buffer is still required. Although the limits of the existing sanitary landfill
were not correct on the original plan, there was only a 100' buffer between the C&D landfill and the
closed sanitary landfill. Obviously, due to the terrain, the additional 100' of buffer cost the Counties a
considerable amount of space for placement of the accumulated material. We can discuss this during
our meeting on site on May 7th.

Revised C&D Landfill Plan
Dear Mr. Green:
As requested during your meeting at the landfill site yesterday with Vann Waters from our
office and representatives from both Yancey and Mitchell counties, this letter is to certify that the new
Construction and Demolition Landfill at the existing Yancey -Mitchell Landfill is now graded according
to the contours shown on the original plan prepared by Camp, Dresser and McKee and approved by
North Carolina Department of Environment, Health and Natural Resources, Solid Waste Management.
This plan is to be implemented in phases to minimize the amount of grading required to begin utilizing
the C&D landfill. A phased plan and the subsequent request for a 200' buffer between the closed
sanitary landfill and the new C&D landfill were part of the drawing sent to you and Al Hetzell prior to
construction beginning on the project.
During construction, the slope to be constructed along the 200' buffer was inadvertently
constructed in the wrong location. During the meeting on May 7th with you and Jim Barber from the
Fayetteville office of the Solid Waste Section, it was agreed to allow the buffer at the northern end of
the C&D fill area to be moved to 150' and taper back to the full 200' buffer as staked in the field. It
was also agreed that some material would be replaced in the bottom of the proposed disposal area to
restore it to near the original contours on the approved plan. Both these items have been completed.
The temporary slope is now in place along the buffer, which is 150' at the north end and 200' from the
midpoint to the southern end. Approximately 10' of earth was replaced in the bottom of the disposal
area and except for grading necessary for an access road, the area is close to the original contours
shown on the plan.
Per your request during the meeting, we will submit a revised plan delineating disposal cells
for C&D material. As directed, Cell 1 will be the area currently ready for material and will be available
immediately for placement of the accumulated waste material already at the landfill. Future cells will
be shown on the new plan and will be developed as grading progresses. The counties will still proceed
with grading the C&D landfill in phases as further disposal areas become necessary.

We appreciate your assistance in getting this C&D landfill ready for acceptance of waste and
request approval to begin hauling the accumulated material as soon as possible. The counties are
anxious to begin utilizing the first cell immediately.

Dear Mr. Coxey:
This letter is to verify that I am in receipt of your correspondence dated May 22, 1997, in
regards to the preparedness of the Yancey -Mitchell Construction/Demolition (C/D) site for
commencement of disposal activities. As was explained during my recent site visit on May 21,
1997, upon receiving a certification letter attesting to the fact that the site was constructed in
accordance with the approved plans submitted by CDM, the Solid Waste Section (the Section)
would allow for limited disposal activities to begin. A permit for the facility was initially issued
on November 2, 1994, however due to various reasons beyond the control of all parties involved,
the site was finally constructed according to the approved plans and verified by myself on May
22, 1997. Therefore, it has been determined that the Yancey -Mitchell C/D Landfill is now
Authorized to accept appropriate C/D waste for disposal.
It should be noted that the permit for the site cannot be issued until the facility drawings
are updated, and the active cell areas delineated. Once the Section is in receipt of this material
and a cursory review is accomplished, to verify that the drawings accurately reflect what has
been viewed at the site, the final issuance of the permit will be completed. Please be advised
that this letter is NOT a Permit to Operate, but represents an agreement between the Section
and Yancey -Mitchell Counties that the immediate removal of the accumulated stockpiled C/D
waste may be placed within the area designated as Cell 1. Any additional C/D waste brought to
the site must be stockpiled until the issuance of the permit is accomplished. To avoid and
subsequently eliminate any unnecessary buildup of leachate within the bottom of the disposal
area, please fill Cell 1 as quickly as possible with the accumulated stockpile. Upon the
completion of disposal activities for the accumulated stockpile, apply a suitable covering of six
(6) inches of soil. Thereafter, the facility will be run according to the conditions specified within
the operating permit.
