Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 ADDITIONAL COMMENTS 1. Site has lockable gate and sign at entrance. Roads were in good shape. Good job. 2. Concrete crushing and separating is needed. Section staff explained 75% rule (§ 130A-309.05. Regulated wastes; certain exclusions) and the need for material to be removed otherwise it becomes disposal. Basically 75% of the material should be recycled within a calendar year of when its first received. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 7 2. There was good cover but side slopes steeper than 3:1 along east side and couple other areas. This became a requirement in new 2021 LCID rules, sent via email to Mr. Hunt on 1/13/2022. A copy of the letter sent from the Section, informing of the upcoming rule requirement of closure for NLCIDs, dated 10/6/2021 was also attached in the email. Side slopes and waste should be inside the 2 acre notifications Edge of Waste (EOW) boundaries and marked so the corners and waste boundary can be determined. Markers were present but not easily visible due to vegetation overgrown along bottom perimeter. Please fix the EOW markers, add more so that one can be seen to the other, and be sure all waste/soil cover is inside the 2 acres marked onsite. Pull back any waste/soil, then cover to meet 3:1 slope. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 7 N1111 1. Road access was in good shape with working face being very small. Logs and cones were used to funnel traffic to desired dumping area on top. No unapproved wastes were visible. Good job. 2. Along the south side and in couple smaller areas around perimeter, the waste disposal is not utilizing the entire area inside the existing EOW markers. Along north side waste is slightly beyond the markers. Please be sure to cover and slope 3:1 and do so inside the approved 2-acre notification. Waste along NW corner should be brought back inside this area. Better EOW markers should be installed, suggest tall white PVC pipe, on the corners with one visible to the other so buffers and size can be measured correctly. NW corner, along north side. Needs waste pulled back, covered and sloped 3:1. Small relatively unused area in SW corner of 2 Acre Notification. EOW marker on right hard to see. Discussions onsite with Mr. Hunt consisted of him resubmitting a request for a permitted LCID in an adjacent area he thinks will meet minimum requirements. Ming Chao is the Permitting Engineering Project manager for Cumberland County now and can assist you through this process. His contact info is - (919) 707-8251, ming.chao@ncdenr.gov. Closure and post closure care requirements were also discussed for the NLCIDs when that time comes. 4. Corrective measures are necessary as a result of this inspection and should be complete within 30 days’ receipt of this inspection report. A follow up will be conducted around that time or shortly afterwards to confirm.
