STATUS OF PERMIT:
A Permit Approval To Operate 8606-MSWLF-1998 MSW Landfill Phases 1, 2, 3 & 4 and 8606-LCID-2020 Land
Clearing and Inert Debris Landfill and Permit for Closure for 8602-MSWLF-1983 (Mt. Airy), 8602-CDLF- (Mt. Airy),
and 8602-CDLF-2011 (Mt. Airy) was issued to Surry County on December 16, 2020.

OBSERVED VIOLATIONS:
15A North Carolina Administrative Code 13B .1626(2)(b) states: “Except as provided in Sub-Item (c) of this Item, the
owners or operators of all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of
each operating day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors
and scavenging, and to minimize fires and the generation of odors.”
During the inspection, multiple portions of the landfill surrounding the current working face had not been adequately
covered at the end of the previous working day leaving waste exposed. An area of most concern was located at the
southern extent of the current lift. Mr. Collins explained waste was last placed in this area on January 24, 2022. As a
result, Surry County is in violation of 15A NCAC 13B .1626(2)(b) for failure to cover solid waste with six inches of
earthen material at the end of the operating day.

To achieve compliance, all waste within the landfill must be covered with a minimum of 6-inches of earthen
material or approved alternative cover material at the conclusion of the operating day.
ADDITIONAL COMMENTS
1. The facility consists of a lined municipal solid waste landfill unit, white goods area, tire collection area, a land
clearing and inert debris landfill unit, and a recycling area for the collection of paper, cardboard, glass and plastic
containers, aluminum, steel cans, batteries, cooking oil and electronics.
2. The facility is permitted to receive waste generated within a 90-mile radius of Surry County.
3. Scrap metal is collected adjacent to the concrete pad designated for the collection of white goods.
4. A gate was provided at the entrance of the facility to prevent unauthorized access.
5. The facility had proper signage.
6. This was a partial inspection to observe the operations of the facility.
Operations Inspection of the MSWLF Unit:
7. At the time of the inspection, waste was being placed along the eastern edge of Phase 4 at the transition point from
Phases 1 and 2.
8. The working face was very small and compact.
9. A small amount of windblown waste was observed along the eastern edge of the active area. Please ensure all
windblown waste is collected and returned to the working face at the conclusion of the operating day.
10. Edge-of-waste markers were in place around the perimeter of the landfill.
11. The rain liner was in place over the portions of Phase 4 where waste had not yet been placed.
12. All access roads were of all-weather construction and well maintained.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

Operations Inspection of the White Goods Area:
13. All white goods were being collected on a concrete pad adjacent to the scrap metal staging area.
14. All appliances containing chlorofluorocarbons (CFCs) were maintained in an upright condition.
15. This area was well managed.
Operations Inspection of the Tire Collection Area:
16. Scrap tires are placed in a 40-yard roll-off container throughout the operating day. Once the container is full,
facility staff haul the tires to the scrap tire vendor.
17. Please note, whole and partial scrap tires capable of holding water shall be covered upon receipt with a
water shedding material or disposed of, processed, or removed from the site within ten (10) days of receipt.
18. This area was well managed.
Operations Inspection of the LCID Unit:
19. The working face was less than one acre in size at the time of inspection.
20. Majority of waste was covered with soil.
21. No unacceptable waste streams were observed.
Supporting Comments:
22. A convenience area for the collection of household waste is provided adjacent to the recycling/baling facility.
County residents place household trash into one of three 40-yard roll-off containers in order to reduce traffic in the
MSWLF.
x Please ensure any waste deposited onto the ground during operation of this area is collected throughout
and at the conclusion of the working day and properly disposed.
23. During the inspection, a wood storage and grinding area was observed just north of Phase 4 of the MSWLF
Unit. Mr. Collins stated storage of wood waste had been ongoing for approximately four to five months. He
explained that waste had recently been ground for the first time by a private contractor. The site map
included with the approved Operations Plan for the facility delineates a “Mulch Storage Area” north of
Phase 4 but makes no mention of wood grinding operations at the facility.
x Upon discussion with the Permitting Branch, within 30-days of issuance of this inspection report, a
revised Operations Plan must be submitted to the Solid Waste Section detailing the wood grinding
operation. Details should include, but not be limited to, wastes excepted, storage limits, waste
screening practices, and frequency of grinding.
