Purpose of this visit was to do a follow up inspection on the Robeson County Landfills and the recent Notices of Violation Corrective Actions. All violations were resolved and a Resolution letter for the MSWLF will be sent with this inspection, on 2/3/2022. No paper letter will be mailed only via email. 2. Mulch is being taken from Cumberland County, as available, for 50/50 mix ADC. Robeson County has also taken mulch from Town of Fairmont’s YWN. Records onsite, provided by Ms. Kristina, showed loads of mulch, where it came from, how many loads etc. Also, cover logs for the landfills were provided. Discussions onsite were also to start soon taking City of Lumberton’s mulch. Robeson County Solid Waste (RCSW) uses tarps for daily cover, while using ADC to cover regularly and soil weekly. Be sure and document mulch being mixed with soil according to rule, depending on where it goes for cover, such as CDLF or MSWLF. Remember, the MSWLF should be covered with soil daily, unless using a form of Approved ADC, from the guidance document, to cover. Remember ADC soil/mulch 50/50 mix cannot be used for intermediate cover and be sure covering with soil is at the proper frequency with using ADC 50/50 mix. So older closed cells which will not have waste will need proper soil covering, sloping, and vegetation established etc. RCSW cover logs for MSW. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. There was small area on top, south of working face near older phases, which had a rather thick layer of mulch. Mulch can be accepted up to 50/50 mix with soil by volume and applied for cover. Be sure the mulch and soil are being properly mixed and used to a maximum full depth of six inches. Upon speaking with RCSW staff, Mr. Gene used equipment onsite to spread of the mulch thinner and mix further with soil onsite to adjust the depth and mixing ratio during the inspection. This area had a small berm built up which provided shade and held ice/snow/rain from recent storm and had standing water/ice. Water shall not be impounded over waste. Cover and slope better in this area to prevent standing or holding water, even if snow/ice is present and melts. This area had some windblown/exposed waste as well. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 9 After Mr. Gene spread mulch thinner and mixed with soil, and covering exposed waste. Area will need more soil for intermediate cover to meet rule. 4. Phase 4 still has working face and it seemed a little larger upon first inspection. After witnessing the operation of the face, cover was being applied and spread well and the working face shrank to a more manageable size. Good job. Mr. Powell drove around LF along bottom and went to the top, getting out periodically and walking to inspect compliance issues and hard to see areas of the LF. Windblown was much better with staff actively picking up windblown during inspection. Sides of the MSWLF as a whole looked good with some vegetation taking root. Additional vegetative cover is needed until spring when some perennial grasses should be established for long term erosion control. Slopes were more 3:1 ratio and cover was good. Good job. 6. Sampling was still needed for recent leachate releases and has now been submitted to Elizabeth Werner, Hydrogeologist for the Section. After sampling results were submitted, Ms. Werner responded via email to RCSW Consultants inquiry, “The Solid Waste Section (Section) has reviewed the deeper soil samples and groundwater results from the ongoing assessment of the June 2021 leachate release. The Section concurs to quarterly monitoring of the effected wells. If attenuation is not seen in a timely manner, further assessment and corrective action may be warranted. The Section looks forward to reviewing the final report and recommendations.” Final report will be submitted soon from Hunt Environmental Associates. RCSW needs to follow up and ensure this report is submitted in a timely manner and follow Ms. Werner’s guidance. View of south eastern side of MSW and ditch between EOW and leachate collection tank. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 8 of 9 7. Operations are currently still in Phase 4 on MSWLF. Cells for Phase 5 and 6 are constructed. The seep and severally eroded area, where cells join inside corner, still looks good. Has more soil cover now. Due to shape and contour it still allows for storm water to funnel into small area feeding to new cell. View is approximately east. Working face visible as well. 8. Any permit issues, problems or operation alterations that Robeson County may wish to change should be directed to Benjamin Jackson. Any changes need to be approved before they can take place. Additional grading and erosion control measures may need to be added to the areas where there are reoccurring erosion issues. Repair current erosion control structures. Refer to approved plans and or discuss with Engineers for recommendations on correcting these issues. Areas not being used shall have vegetation established, and that should be good perennial grasses. 10. The Landfills have improved very much in past year and the hard work from its staff/management shows. Please continue with the diligence in maintaining the conditions moving forward. There are some things needing attention, mentioned in this inspection, to further improve and maintain the work done at the landfill. There will always be improvements and work needing to be done. Be sure and take advantage of the spring planting season with establishing perennial grasses on the side slopes and older areas which won’t receive waste. Remember ADC soil/mulch 50/50 mix cannot be used for intermediate cover.
