ADDITIONAL COMMENTS
1. Purpose of visit was to do a follow up inspection on the Robeson County Landfills. 2. CDLF has now moved into new cell with the working face. Working face was small, compact and no unapproved waste was visible during inspection. Good job. Older cells had good cover and proper sloping in most areas.
Top of the CDLF was a little flat and had a couple wet spots from recent weather. Rain/Ice/Snow event was just few days ago and ice is melting slowly. Add additional cover and slope so that water cannot accumulate on top the CDLF. Older cells need additional cover and proper vegetation to prevent erosion etc. according to rule. Spring is fast approaching and this is the proper window for establishing perennial grass cover on these areas of the CDLF, MSW and NLCID. Older equipment cannot be stored on top CDLF, please remove. Ruts from recent traffic can hold water and need addressing when weather allows. Remember ADC soil/mulch 50/50 mix cannot be used for intermediate cover. 15A NCAC 13B .0542 (f)(3) - Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered and stabilized with vegetative ground cover or other stabilizing material as provided for in Subparagraph (4) of this Paragraph.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

4. Sides of the CDLF were mowed in recent months and markers visible. Good job. Cover was added and sloped on south side and other areas along CDLF perimeter. Stay vigilant with maintaining 3:1 slopes and proper cover. Establish vegetation to maintain the work accomplished and meet rule on older cells not receiving waste with proper intermediate soil cover. Robeson County has done a good job addressing exposed waste and windblown. Good job. Previous seep repair areas on west side of CDLF into new cell still look good.

5. Mulch is being taken from Cumberland County as available for 50/50 mix ADC. Robeson County has also taken from Town of Fairmont’s YWN. Records onsite, provided by Ms. Kristina, showed loads of mulch, where it came from, how many loads etc. Also, cover logs for the landfills were provided. Discussions onsite were also to start soon taking City of Lumberton’s mulch. Be sure and document according to CDLF/MSWLF rule, depending on where it goes for cover etc. Remember, the CDLF should be covered when the waste disposal area exceeds one-half acre and no less than once weekly, and follow the Approved ADC guidance from the Section. Also, ADC soil/mulch 50/50 mix cannot be used for intermediate cover and be sure covering with soil is at the proper frequency with using ADC 50/50 mix. So older closed cells which will not have waste will need proper soil covering, sloping, and vegetation established etc.
6. Treatment and Processing Area didn’t have any unapproved waste that was visible.

7. Mobile Homes are still being deconstructed in same area. Only one was present during visit. Discussions with Ms. Kristina onsite were that the County will demo the MH if not enough for contractor to come and deconstruct.
8. White goods and scrap metal storing area was in fair condition. Anything containing CFCs should be upright until the gas is removed. All waste should be on concrete pad, which most was this time, good job.
9. Additional grading or erosion control measures may be needed moving forward where there are reoccurring erosion issues. Refer to approved plans and or discuss with Engineers for recommendations on correcting these and the other issues mentioned in this inspection. Exposed soil shall have vegetation established, and that should be good perennial grasses. Seeding and mulching of soil cover in a timely manner may assist in reducing some of the erosion issues at this facility. Remember soil/mulch 50/50 mix cannot be used for
intermediate cover.

10. Tire collection area was in good shape with three trailers. All were orderly stacked in trailer. Good job.

11. Discussion after inspection with Ben Jackson, were in part that Mr. Walters still wished to demolish MHs’ on top the CDLF. Mr. Powell asked Mr. Walters to submit a plan within the following couple weeks to satisfy Mr. Jacksons requirements/requests or respond that this isn’t the path he wishes to go forward any longer. Also, discussions were about the new permit in which it stated that in part the CDLF could accept “Land Clearing Waste”. Robeson County staff were unsure if this was an error etc. Upon discussion it was understood that this permit condition, based upon rule and the definition of “Land Clearing Waste,” that the CDLF could accept this waste type if the waste was sourced of construction and demolition activities as defined. However, Robeson County does not have to choose to accept this waste in their CDLF. Upon inquiry, Mr. Walters and Ms. Kristina determined that this could potentially be a problem and not necessarily the path forward the County wished at this time. Mr. Powell explained to just see this permit condition as something the County could do if they wished, and did correctly in future, but they didn’t have to accept that waste type in the CDLF. Any permit issues or problems or operation alterations that Robeson County may wish to change should be
directed to Benjamin Jackson. Discuss mobile home deconstructions requirements and options with Mr. Jackson. Any changes need to be approved before they can take place. 12. The Landfills have improved very much in past year and the hard work from its staff/management shows. Please continue with the diligence in maintaining the conditions moving forward. There are some things needing attention, mentioned in this inspection, to further improve and maintain the work done at the landfill. There will always be improvements and work needing to be done. Be sure and take advantage of the spring planting season with establishing perennial grasses on the side slopes and older areas which won’t receive waste. Remember ADC soil/mulch 50/50 mix cannot be used for intermediate cover. Follow up with Ben Jackson and be sure Section permitting has what they need to continue working on permits for Robeson County and any request the County has made for modifications/changes etc.
