PURPOSE OF SITE VISIT: Routine
STATUS OF PAST NOTED VIOLATIONS: No violations noted on the previous inspection.
OBSERVED VIOLATIONS:
1) Vegetation was grown up between the tanks. See pictures below. The grown-up vegetation between
the tanks is a violation of Rule 15A NCAC 13B .0838(i) that states “the area around tanks shall be free
of debris and vegetation to allow for access and inspection for a distance of 5 feet.” The vegetation
needs to be maintained so that the side walls of the tanks can be inspected.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1) This facility has three metal tanks present but, only the center 10,000-gallon tank is permitted to be
used. The two 15,000-gallon tanks have had leaks in the past and have been taken out of service. This
facility is located on the same property as Septage Land Application Site, SLAS-79-04.
2) The “No Trespassing” signage present on the building prior to reaching the tank. This meets the
requirement of Rule 15A NCAC 13B .0838(k).
3) The access road to the detention facility is in good shape and meets the requirement of Rule 15A NCAC
13B .0838(b).
4) Tank not accessible for inspection. The vegetation had grown up around the tanks making it impossible
to inspect the side walls of the tanks. As stated in “Observed Violations” above, the overgrown
vegetation between the tanks is a violation of Rule 15A NCAC 13B .0838(i). And even though the two
tanks bordering the center tank are no longer in use, the area around those tanks also needs to be
maintain because there is still septage present in those tanks.
5) Not able to inspect the side walls of the center 10,000-gallon metal tank to check for holes or cracks
which may allow the escape of septage out of the tank as per Rule 15A NCAC 13B .0838(c). Encourage
you to remove any remaining septage out of the two – 15,000 gallons tanks.
6) Septage appears to be transferred to and from the tank in a manner that prevents leaks or spills of
septage onto the tank or ground as per 15A NCAC 13B .0838(j). No septage spills noticed.
7) No vector or odor issues noticed as covered within Rules 15A NCAC 13B .0838(e)(2) and .0838(g).
8) No change noticed that would affect setback distances.
