PURPOSE OF SITE VISIT: Routine STATUS OF PAST NOTED VIOLATIONS: Septage debris was not observed around the buried concrete tank.
OBSERVED VIOLATIONS:
1) Septage noticed on the ground by the 7,000-gallon plastic tank around the gate valve. Streaks of grease
septage was also noticed on the side wall of the 7,000-gallon plastic tank. This is a violation of Rule of
15A NCAC 13B .0838(j) that states “Septage shall be transferred to and from a detention system in a
manner that prevents leaks or spills of septage onto the ground surface or exterior surface of the
detention system, including septage in pipes used for transferring waste to and from vehicles.” Any
septage on the plastic tank or on the ground shall be cleaned up. Also in the future, the transfer of
septage to and from the facility needs to be done in such a way to prevent the leaks or spills of septage
onto the ground or onto the tanks.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1) Access road to the tanks is well maintained and meets the requirements of Rule 15A NCAC 13B .0838(b).
2) “No Trespassing” signage at gate entrance to facility and meets the requirements of Rule 15A NCAC 13B
.0838(k).
3) The two (2) above ground poly tanks were accessible for inspection and free of debris and vegetation as
per 15A NCAC 13B .0838(i). The 3,500 gallons concrete tank is a below ground tank.
4) The two poly tanks appeared to be ok. No leaks noticed.
5) Septage was noticed on the ground by the bottom valve and on the side wall of the 7,000-gallon plastic
tank. I talked to Billy about the septage on the tank and by the valve at the bottom. They were going to
work on improving how septage is transferred to and from the 7,000-gallon plastic tank. No septage
debris was noticed on the ground around the buried concrete tank.
6) No odor or vectors issues noticed.
7) No change noticed that would affect setback distances.
8) There was a metal ramp going from the gravel area around the buried concrete tank to the 1,500-gallon
plastic tank. The metal ramp can be a safety issue with no means to prevent someone from falling off it.
