Solid Waste Management Rules, 15A NCAC 1313, .0201(b)(1). The County purposely did not want to include this capability in order to avoid additional expenses incurred that we did not feel we could easily recoup. We have of late found it necessary to request that our permit be changed to allow some residences within Yancey County, NC be allowed to use our services. That of course would include all Municipal Solid Waste. The Wolf Laurel Resort is a gated community that encompasses many acres in the northeast edge of our county. There is only one way in and out through the property located in Madison County. There is however several acres of the resort that are within Yancey County. They county line follows a ridgeline that is within the Wolf Laurel Resort. (Please see attached map of the area) Because of the geography Madison County feels it would be an unnecessary burden on these residents to require them to travel to Yancey County to dispose of their MSW. We estimate there are 200 homes located in the Yancey County side of the resort. That equates to approximately 2% of the total households within the county. Control of the Yancey County users will be through the Solid Waste Disposal Card that will be issued upon proof of residence within this community in Yancey County. Madison County would like to change our permit to include these residents. What do we need to do to change our permit? James L. A small amount of unacceptable waste observed in landfill: plastic car bumper, 3 metal barrels, oil tank, tire, and metal culvert. 5. A large amount of cardboard was observed in the landfill. While this cardboard appeared to be associated with construction waste, it could easily be recycled. 6. The working face of the landfill was properly sloped and the waste was appeared to be properly compacted. 7. The completed area of the cell has been shaped, graded, and seeded. A good stand of grass was observed. 8. Very little space remains in the permitted area. 9. The overall operation looked good. The change in service area would only include certain residents of the Wolf Laurel Resort community. As described in your letter, Wolf Laurel is located primarily within Madison County, but a smaller area is located within Yancey County. The proposed change in service area would include only those residents living within the part of the Wolf Laurel community located in Yancey County. As I understand it, the municipal solid waste would be accepted at the transfer facility located within the MSWLF facility boundaries and then transferred to the Carter Valley Landfill in Tennessee. The construction and demolition debris received from this area would be accepted for disposal at the construction and demolition debris landfill(C&DLF) also located within the MSWLF facility. Given these circumstances, a request to change the service area would constitute a substantial change to the waste stream defined in the effective permit, and a new facility permit would be required. Under the solid waste management rules (15A NCAC 1313), Local Government Approval (LGA) in accordance with .I618(c) (5) (A) would be required with a revised Facility Plan prepared in accordance with .1618(c) (6). Since there are no proposed changes to the site development, landfill construction or operation, the LGA and the revised Facility Plan would reflect only the change to the service area, and any resultant changes in landfill disposal rates or useful life. Also, the permitting and public information procedures of the solid waste management rules require the Solid Waste Section (Section) to provide an opportunity for public review of and input to permit documents.
