County staff assisting in the audit: Jim Brown, Date of Audit: January 26, 2001 Purpose of Audit: To preform a comprehensive inspection of the municipal solid waste landfill and its associated units. Violations Noted: (A) 15A North Carolina Administration Code 13B .1626 (2)(a) 1. The owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day or at more frequent intervals if necessary to control disease vectors, fires, odors, blowing litter and scavenging. To correct this violation, a minimum of six inches of earthen cover is required at the end of each day of operation. Comments and Suggestions A.) Because of windy condition windblown trash needs to be collected and returned to working area. B.) Working face could be smaller in area. C.) The well monitoring records, facility monitoring records, tire records, methane monitoring records and semi-annual water quality data were available and in order. D.) C&D area is in good condition. E.) The storm drainage swales were in good condition. F.) The sediment ponds were in good condition. G.) The leachate pond was in good condition, H.) Completed slopes on the MSWLF need to be seed with vegetative cover as soon as weather and growing condition allow. I.) Some tires on the ground and uncovered near tire trailer. J.) County Manager PO Box 579 Marshall, NC 28753 RE: Madison County's MSW Disposal Permit # 58-03 Madison County, Facility Dear Ms. Davie: NCD1;'t:-- NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES As you are aware, the Madison County MSW Landfill, Permit # 58-03 is near it's maximum capacity. It is a concern that Madison County is rapidly running out of landfill space, current estimate 2 months or less, and the Transfer Station which the County is planning to build will take several months to complete. As of today, the actual construction of the facility has yet to begin. I want to encourage Madison County to do all that is can to facilitate the completion of the Transfer Station construction as soon as possible. If the Transfer Station construction has not been completed in time to receive the County's MSW when the landfill has reached it maximum capacity, other arrangements will need to be made. Madison County should have a plan, how it will handle its waste stream, ready to be implemented should it be needed. This plan would need to include who will transport and who will be receiving the waste. If you need my assistance, please don't hesitate to contact me at 828-251-6784 ext. 280. RE: Landfill Fire Mr. Hetzell: As you know per our phone conversation on 5/1/01, the Madison County Solid Waste landfill caught fire on the afternoon of 4/30-01. The Marshall Fire Dept. was called and responded within 15 to 20 minutes, they pumped water over the area of about 150'x 50', the fire was controlled. There was some hot spots underneath still smoldering that the landfill personnel covered with more soil. We stood by for about another hour to make sure that there No other danger. We have no idea how the fire started, actually there was more smoke that fire. There was no physical damage to the landfill. Matthews, Interim Director CERTIFIED MAIL November 19, 2001 Anita Davie County Manager Courthouse, Box 579 Marshall, NC 28753 Re: NOTICE OF VIOLATION Madison County, Permit #58-03 Dear Ms. Davie: You are hereby informed that the Madison County Solid Waste Facility, Permit #58-03, is in violation of the North Carolina Solid Waste Management Rules codified at Title 15A Subchapter 13B of the North Carolina Administrative Code (NCAC), specifically: 15A NCAC 13B .1628(e)(1)(F) requires all owners or operators of municipal solid waste landfill (MSWLF) units, who are using the Local Government Financial Test to satisfy the financial assurance requirement, to submit a letter signed by the unit of local government's chief financial officer (CFO) and worded as specified in Part (e)(2)(G) of this Rule. This letter must be submitted to the Division annually within 120 after the close of each fiscal year. The annual update was officially due on November 1, 2001. Madison County is required to comply by taking the following actions: 1. Submit, within 14 days of receipt of this letter, an updated Local Government Financial Assurance Test using detailed third party cost estimates based on current dollars for Madison County's fiscal year ending June 30, 2001 or submit documentation of another acceptable mechanism as provided in 15A NCAC 13B .1628(e), or request an extension of the deadline in writing including the date, in which you expect to submit the Financial Assurance Mechanism.
