We're taking advantage of the weather today (12/9/09). Randy will be at the Avery site this

Dear Mr, Wagner:
Avery County has prepared this response to the NOV (Notice of Violation) and other areas of
concern (AOC) provided in the audit report received October 29. 2009 (copy attached). As a
means of clarifying our actions forward with respect to the closed MSW landfill, we offer the
following responses to address each violation or concern followed by our proposed corrective
action. Please find each violation in italics and the associated response below.
Notice of Violation
Avery County is in violation of 15A NCAC 13B.0510 (c) failing to perform the necessary
maintenance at a solid waste disposal site that has been closed in accordance with the
requirements of the Division, as specified in the closure letter, in accordance with the
requirements of Rule .0510(c) of this Section.
Response
We have engaged our consultant Richardson Smith Gardner & Associates, Inc. (RSG) to assist
the County in preparation of a Methane Monitoring Plan on or before Wednesday; January 27,
2010 (90 Days from receipt of audit) in accordance with the Section's request,
AOC No. 6
A 35-gallon condensate tank T" (that is part of the designed gas condensate collection system)
that is believed to be located in the area immediately to the east of the entrance, still has not
been located. This condensate tank must be located and marked.
Response
The County proposes to confirm the existence of condensate tank "B", However, recent data
presented by the Energy Xchange (exchange, the developer of the gas system) appear to show

Buddy,
Repair to the condensate pipeline was made December 9, 2009 by Randy McMahan (an
EnergyXchange employee). There was a break in the condensate collection main pipe l
break appears to have been a collision between the stand pipe and a grass mower. New
connections were put in place and the pipe was repaired to its original design. After the repairs,
observed to be functioning properly.
Additionally, EnergyXchange is in the final stages of negotiating a contract with Richardson,
Smith, Gardner and Associates to provide operation and maintenance services for the gas
collection and control system at the capped Avery County Landfill. Services should begin in
January. Our previous operator, McGee Environmental, Inc. went out of business and is not
longer providing such services. We will let you know once a contract with RSG has been
established.
